2005 Stolen Valor act question

For those in the legal profession, I have the following question.

There is a Marine locally that was tried and convicted under the 2005 Stolen Valor Act which was subsequently repealed and replace with a different version in 2013 (I think)....

My question is with the repeal of this 2005 act as being in violation of 1st Amendment rights, is this person still carrying this sentence or would it be dismissed?

He probably would need to take some action (in court, with a lawyer) to have that vacated. It might not be difficult, but my distaste for such conduct makes meant ant to be of use in doing so.
