The case against Baldwin was dismissed today with prejudice. The judge, acting on a defense motion, cited a Brady violation. Apparently / allegedly there was a box of live ammo laying around somewhere that the prosecution did not think was relevant so they "didn't bother" to tell the defense about it. The judge disagreed.

I noted earlier this week that the convicted armorer said she would not testify on 5th amendment grounds. I assume that is because she or her attorneys felt it might prejudice an appeal.

Then I read that a box of ammo was handed in by 'a good Samaritan' that was supposed to be the source of the live ammo on set. However, the forensic tech testified...

...and despite similarities was not the same size as the live rounds found on the “Rust” set, including the one that killed Hutchins.

The same size? WTH does that mean? Different loaded length, completely different caliber? Either the reporting has been sub-edited of the detail, or the words used in the court are staggeringly imprecise. This new box seems to be the ammo given as grounds for dismissal. If so, how come the judge would see it as grounds for dismissal when it could never be used in the shooting? Was the judge looking for an out?

Correct me if I"m wrong but if you have a gun with chambers for the .45 Colt, it'll also take .44-40, .38-40 and .44 Special. Hence
the 4-in-1 Hollywood blank cartridges.

Accuracy with actual bullets will suffer but they can be fired at close ranges with reasonable hits.
 
Why was there live ammo on set is the question. And again as producer isn’t he somewhat or even completely responsible
 
Yeah often wondered how and why live ammo was on the set to begin with. Figured it was brought in to shoot the guns during off hours. Wonder how much Hannah really knew. Baldwin claims he never pulled the trigger. Wonder about that one!!
 
…The right person was convicted.

If there is a logical explanation for that thought, I’d be interested. That’s akin to the fuel service neglecting to fuel the plane and the captain taking off without sufficient fuel and flying into a crash. See who gets blamed for that one.

I don’t get the “with prejudice.” Is that normal in a case where the state was obviously playing with cards beneath the table?

I’d like to know more about this thing before I’d venture that justice was done, but I’m pretty sure a LOT of money changed hands at various places. :o Agreed no sane person ever really believed the actor would end up in prison. That stuff is for the little people. :o
