Another manufacturer lawsuit

The Tops Markets shooting story has kinda died off on the national level but it is still very much alive on the local level. Yesterday the shooter was sentenced to life without parole. He will now face federal charges with the death penalty being a possibility. NY does not have the death penalty. All the civil lawyers and even the county DA are pursuing libel civil suits. You may ask, an evil person did evil things and will spend his life in jail. Who is libel other than the evil person????? Well the firearm manufacture of course! They've already stated they are using Sandy Hook law suit as the template where Remington paid out $$73mil. The DA is pushing for new law to make it easier to sue anybody and everybody. We'll see where it all goes. Wouldn't surprise me if the Tops grocery chain gets sued as well.

Living here in The EMPIRE i'm surprised they don't sue the Manufacturer of the Vehicle he drove to the Tops Grocery Store or the manufacturer of the automatic door opener that allowed him in..

Remington didn't do anything - THEIR INSURANCE COMPANY DID. Grudges are fine, just make sure you're holding them against the right people.

It is a catch 22 with the insurance companies. Basically, once they are involved, they call the shots on the settlement.

If the insurer has an acceptable settlement on the table and the insured declines to accept the settlement, then they are on the hook for any awards over and above the amount the insurance company could have settled for or maybe all of it depending upon how the policy is written.

It puts all the risk of ongoing litigation on the insured which is not a risk most companies are going to accept.

Smart lawyers know this and taking the novel approach regarding the marketing put them in a perfect position to push in a settlement.

At some point, someone will have to decide to go the distance to establish case law one way or the other. These suits will continue to be filed and more than likely settled because the plaintiffs have no interest in going to trial, they just want to get paid. At some point, insurers will not write policies, so the anti's get a two-fer making money on the settlements and eliminating insurance for manufacturers.

It is a shame, but the way things work today.
