So I went to my LGS of Friday and bought a used S&W revolver. I completed all of the paperwork and after about a 30 minutes was told my transfer had been 'delayed.'

OK, not real happy but its good to know they are actually checking. I received a call today (Monday) telling me I had cleared (no surprise to me). When I went to pick up my new revolver I asked the clerk if she knew why I had been delayed and she said she did not.

I began to tell her that I have multiple security clearances, USMS, ICE, DHS and was worried something may come up on my next renewal and she said this was probably the reason. She then told me that the 'Level 1' approvers could not see all of my information and the clearance needed to go to the 'next level' for approval.

I have had these clearances for years and never been delayed before. My clearances are not Secret or anything fancy/special and this sounds like BS to me. Thoughts?

Some nice fella' about your age, with similar other identifiers and a similar SSN, has decided to interact unfavorably with the criminal justice system since you last purchased a firearm. I've got my own doppleganger that occasionally causes me a minor issue, even with a UPIN . . .

Edit: She really didn't care about anything you were telling her about your past, and that conversation wasn't going to move things along any faster. "Oh, I'm sorry, you're a Navy Seal? Proceed, of course . . ."

All should be aware that very recently the U. S. House has passed a bill which has the potential of slowing background check completions greatly. Hopefully it will get nowhere in the Senate. Does AZ have a law allowing concealed permit holders to skip the background check?

It happens occaisonally. I don't have any special clearances. But I get a delay, including one on a shotgun two weeks ago.

AZ does, it also allows concealed carry with out a permit, I let mine lapse when they removed the requirement for the permit.

Get your concealed weapons permit and avoid the wait.

AZ does not require a permit to carry concealed. When they did I had one however even though the law did not require those with CCW's to go thru the Instacheck system most dealers did it any way, I think this was their way of trying to limit their liability in the event someone did something stupid (Remember AZ was ground Zero for Holder's ATF's Operation Fast and Furious).

So what? I have had mine since 95. I get to carry in other states. I avoid waits for background checks. I can carry in restaurants that serve alcohol Since 95 I have never encountered one of those dealers you speak about. I'm in and I'm out as fast as the inspection, paperwork, and payment can be completed. No phone calls. No wait. Ever.

I am happy to hear your experience has been different than mine.

Do you get any break on the transfer fee?

That I got delayed is not an issue for me, As I previously stated I am glad they are checking but I still call BS on the clerks statement that my background was delayed because of my previous clearance.

But, at least in NC (for now) having a CCP makes FTF transactions possible. No background check necessary. Already done when the permit was issued. YMMV

Was the clerk you last talked to the one who actually did the initial check?

If not, she probably doesn't know nor care and was just giving you an answer, any answer, to get you to go away and stop asking her questions.

I wouldn't worry.

A background check must be done on each and every gun you buy from a dealer. Security clearances past or present mean nothing.

Delays can be caused for different reasons. As Muss said, some dummy with a name very similar to yours committed a crime. Or sometimes the folks at NICS are too busy or short handed to immediately process the checks. So they get delayed.

If the dealer is using the E-Check system, for all you know the dealers computer could have frozen.

Back when we called in background checks, every once in a while we were elevated to a tier two agent. That normally happen with common names like John Smith. That's were the UPI number helps.
