I ran a guy off one time for flying over my house taking pictures the trying to sell them to me for a high but extremely fair price.
People on the news are beginning to dislike drones and I'm wondering how long it will be before people start swatting them. How far up does one own over their property? Do I have a certain amount of private airspace? I have often wondered how far below the surface of the ground do I own.
I think that if someone flies a drone over my place, the Hawks and mosquitos will take down anyways. I just hope it ain't my gun parts delivery from Brownell's.

There are mineral and water rights but I have heard of airspace rights only when the issue of taxing alcohol on planes flying over a state came up. That spawned a lawsuit. Issue was did a state control commerce which did not originate or end in that state. The issue is probably different state by state.

Rule of thumb is if it's over your property it is yours to do with as you please. Not to say you can shoot it out of the air but if you can hose, rope swat or otherwise corral it go for it. Guy down here found out the hard way when he tried to reclaim one after videoing a man's wife and daughter by their swimming pool.

I am not a pilot, but I believe the FAA says aircraft must stay above 500 feet rural and 1000 feet over city limits. The exception is landing. These rules apply to all motorized and non-motorized (balloons and gliders) aircraft. I believe self defense laws apply if you perceive a safety threat. Ivan

To my understanding, air rights over your property are yours unless purchased by another party. When Atlanta/Hartsfield traffic increased about 30 years ago, many people were starting to try and sue the airport. About 25 years ago, the airport sent people out to our area and negotiated with all the homeowners. Central air was installed in any house that didn't already have it, storm windows and doors were installed over existing windows, twelve inches of insulation was installed in the attics and they bought the air rights over the houses. So if no one has bought the air rights, by that precedent, it seems private drones would be fair game. Government owned drones might be a different matter.

I actually got asked just this morning by a fellow I knew what the lead was on a drone. He remembered that years back I did many years of skeet and some trap shooting.

Our satellites can read license plates and see baseball's in our fields so the drones don't need to fly low to spy. Plus the drones are armed right? They can shoot back. Ever think about that? The quality of our optics is much better today.

Drones and aerial pictures

For years people have photo'd farmsteads and ranches hoping to sell the the pics to the landowners/ residents. I imagine the drones are a cheaper way of achieving the same purpose. I too would resent a drone flying over if it seemed so low as to be invasive. My wife says one should not sunbathe topless even in rural areas because Life-Flight may fly over at any time, I don't know how she knows this other than she was an ER nurse

Myself I love the aerial photos we have many of the farm from different years; it's fun to look at them and date them by which crops are in which field, which pickup is in the drive or when the new grain bin was built.

The guys selling the pictures are like vacuum cleaner salesmen; they all have a pitch: " I am down to the last three places and I want to get home this weekend" etc. My shop is on the edge of town and there is a small house next door unrelated to my place. One day a fellow was trying to get the lady to answer the door( she's deaf) in hopes of selling a framed picture that actually centered on my shop. When he came to the shop I knew what he was selling and had already decided to buy. He started his spiel and after stating the price he didn't wait for my response but started in again with a lower price. By the time I got him stopped long enough to say "I'll take it" he had chopped over a hundred dollars off the price.

There was a funny story in the news last night-where a crowd of Hockey fans somehow downed and destroyed a drone flying over them. It was on the CBS evening news broadcast last night--if anyone has a way of checking?

I was watching the Pirates beat the heck out of the Mets this evening and a drone flew over and hovered directly over PNC Park during the game. The outside cameras showed the guy who was operating it walking outside along the river. I don't know for sure but I'd bet someone is going to get a federal government visitor knocking on their door!
