Wasn't there very long either. Appears to be in great condition and I've already been in contact with the seller who seems like a really great person with which to deal. He states that a total of three mags are included so the price is even better.

I even managed to get my 4046TSW moved locally shortly after I hit "Buy Now" for a nice profit so all is well.

Who did better, me or my friend?

I gave him:

4046TSW w/ 1 10-rounder
(7) factory 11-rounders
340 rounds of Winny VP 165 grain FMJ
100 rounds of Tula 180 grain FMJ
50 rounds of Federal Champion 180 grain FMJ
33 rounds of BH Red Box 155 grain GDs
22 rounds of Winny 180 grain JHPs

He gave me:

$600 + 80 rounds of Magtech .45 FMJ for which he has no pistol.

9mm ammo will be more available and cheaper for you to stock up on......you dont need the mags anymore.....so I'd say you did great. I just picked up a 5903TSW last wekend. Gotta see if the High Sheriff will approve for back-up and off duty. Great gun.

I get to pick my 5946TSW up from my dealer tomorrow.

The Mrs. had to return some items to a store today and decided to do some additional shopping so I went to Cabela's in Owatonna, MN. I found an older MecGar blued 15-round magazine on a table of closeouts for $10. The package looked like it'd been water-damaged but the magazine was in really nice shape, there was a small spot of rust on the side that faced the backing board but it had the standard plastic S&W floorplate without the S&W markings and was only $10 so who cares.

They also had MFS .380 in stock for $16.99 per 50 so I picked up a box to add to the pile. I'm due to get my LCP on Wednesday so I need all the .380 I can find.

This type of thing makes me wish I had held on to my old duty TSW, which we bought from the department vendor for $268.75

I'm not at all pleased to say the least but to the guy's credit he did offer a refund. I was hoping for an exchange but he doesn't have any more left. Live and learn I guess. I'm still thinking if asking for a small refund as this is not the pistol on which I bid.

That sucks! Good luck on getting some $ back. It still looks like a nice gun though. But your right, I would be mad too if they used a different pic than the one they are selling :(
 
Well, I just got off the phone with S&W Customer Service and the rep stated that they'll reinstall a rail for nothing so I'm going to take them up on that offer.

I figure that a new set of grips will be $15-20 so I'm going to ask for 10% of the final shipped price to cover the shipping and the grips. That seems reasonable to me but of course it's my idea and of course, I always have the best ideas.

I'm still a bit bummed but I have to realize I got one more mag than initially believed plus I'd rather have a 5946TSW than not. I'd have really liked it to have been in the condition represented though as that was a price and condition of which to be proud.

ETA: I just got off the phone with the dealer and he wouldn't do $42.50 but stated he would do $20. Not the best but I guess it's better than nothing.

All in all sounds like a decent deal. I have been surprised many-a-time with these online purchases, but in the end I keep the items since it does not make sense to send them back. I have been getting more wary over time and less inclined to buy anything I cannot touch in real life. Sellers can be stand-up guys, but there is not much a buyer can do from a thousand miles away.

I love the 3rd generation S&W semi-autos. They are built like tanks and I've never had a malfunction with the ones I own. Enjoy that 5946.
 
Scotter, if this was a transaction made on Gunbroker then I would put up a bigger stink than this. Are these guns that rare that you can't wait for another one? If no then tell him to get lost. There is a reason why people use auction sites to buy guns because it gives you a little fallback if the seller isn't being honest with you. If you go ahead with the deal then I would nail him with negative feedback and see if that changes his mind about what he owes you after the fact.

Also, one of those screws that I assume holds the rail looks pertty buggered to me. If it was my gun I would want that replaced, but I am devil for the details, especially with recent production guns. "Recent" being relative of course.

I didn't slam him, just didn't give him the +.

I told him that as far as I was concerned the transaction was completed satisfactorily after he agreed to the $20 refund so I'm not going to burn him. Satisfactorily doesn't mean that it was necessarily good however.

Look at the pictures, those two pistols aren't even close in condition. The pistol I "Bought Now" was a like new to excellent condition "detective's gun" which would have been a screaming deal. The pistol I received appears to have been a "duty gun". I'm not saying it's not still a decent deal, I'm saying it's unreasonable to think that I should be "pleased" that what I bought turned out to be not what I bought.

dacoontz: I agree with everything you wrote, I just don't want to invest the time as I can live with the outcome - extra magazine, $20 refund, and Smith will reinstall a rail for nothing, not ideal but as indicated, livable. Bear in mind, he did offer a full refund and apology right off the bat saying he thought the photo was representative of the lot of pistols he had. I can't really kick up too much stink as he agreed to make it right immediately and I chose to keep it. They aren't that rare but they don't show up very often so I'm inclined to hold onto it. I requested that in the future he take the time to take pictures of each pistol so as not to misrepresent what he is offering.

I do appreciate your responses though,

Is it me or is your gun's serial number not the same as the one in the picture?
 
As long as your happy with the outcome, that's all that counts.

As for me, I would not be happy. Regardless of the price, the guy pulled a total bait and switch. Advertised an almost perfect gun, and delivered a well used gun that someone modified. Good to hear S&W will fix it, but it shouldn't have been your hassle.
 
I had a similar situation when I bought my 6906. It arrived with unexpected flaws most notability was a broken extractor. To the sellers credit, no claim was made to the guns condition, and a refund was offered. I of course would be responsible for the return shipping and the initial shipping would not be included in the refund, and any FFL fees were my own problem. Meaning I would be in the red for about 60 bucks and come out empty handed. Fortunately my department armorer was able to fix the gun and I only had to pay less than $30 for the necessary parts (total cost was closer to $40 when I decided to order unnecessary parts also). In the end of it all I'm still completely satisfied.

Or at least disclose that it is not an actual photo as many sellers do.

It keeps getting better. I stopped at a rural friend's house about 20 minutes ago and put one 15-round magazine of Sellier and Bellot 115 grain FMJ into his woodpile. Magazine disconnect does not function either.

1st round - Failure to extract
2nd round - Fired and ejected
3rd round - Failure to extract
4th round - Fired and ejected
5th round - Failure to extract
then 3 more FTExs in the rest of the magazine.

I've had so many good transactions that I suppose I'm due.

I've sent an email to him inquiring if a refund would include price + shipping both ways and also gave him a link to this thread.

I am a bit wishy-washy on a refund though as if it has to go to S&W for the rail anyway, perhaps they could get it up to snuff for a small charge and I still wouldn't be out too badly. The only issue is principle, my consolation is that it's not a $1,200 Model 29-2 or worse. I guess we'll see how he responds and go from there.
