Finally!!! 5946TSW found *Thank you Smith and Wesson! Range report on Pg. 8*

These guns had problems if the extractor wasn't fitted correctly, or of the extractor spring was too weak.
 
I think I've made the decision to just eat it. This guy's feedback was all positive so I'm going to hope that it was truly an oversight instead of a swindle.

I got to thinking that I'd posted a WTB ad for a shooter-grade 5946TSW and essentially that's what I got although it may take some work on S&W's part to actually get it shooting and that's not what I bid on.

I've got my letter done to S&W Repairs asking for an estimate on first getting it functional and then second to get it cosmetically rejuvenated. I believe a refinish is $105 and who knows what the functional side will cost but I'll just pick and choose what needs to be done with function being the most important aspect.

I figure the raw materials are there they just need refining a bit.

The only thing I can tell you is that I will never buy a thing from BARRIEGUNTRADER On Gunbroker.

This guy pulled a bait and switch on you, so he will surely do it to others.
 
You are going WAAAYYYY too easy on this guy. He pulled a classic "bait and switch", bullied you into a smaller refund, and continues to do business as usual because you didn't blast him in his feedback. You work hard for your money, we all do, and it isn't unreasonable to expect that we will get what we pay for when we spend it. You are a better man than I.
 
I have bought and sold on Gunbroker. Any reputable dealer would have put a note on the auction, that the photos are "typical" of the guns being sold, but not necessarily the gun you will receive. When you know that going in, it keeps you from paying top-dollar for a possible beater.

If I were in your situation, would I have a problem? YES. But I would have probably handled it like you did.

Let the guy know that YOU KNOW what he did, get some cash back, and move on.

That being said, it would really bother me to buy a rail gun, and open the box to find it "naked".
 
FWIW, I think you were too generous in rating him. His ad didn't say he had several guns, it said there was a single desk cop gun and purported to show pictures of it. The gun he sent you was a different and far lesser grade gun. If he has many and the one in the ad was representative, why not have you send yours back and get one like the one pictured?

I am guessing there wasn't a bunch of them and he sent you the one he did after selling the nice one, or instead of the nice one. He only sold two that I can see and no longer lists them for sale. If S&W will fix it free or cheap maybe it isn't worth the hassle of a return.

He would have gotten a much lower rating from me.
 
You have been taken by a swindler, who will do it to someone else the first chance he gets.
 
Great looking gun. I been trying to find a 5906 in California. I have to have a 10 round mag. They are hard to find.

Personally, I would send the pistol back to the seller and request a full refund including shipping and FFL fees. The seller obviously is guilty of fradulent advertising unless he somewhere stated in his add that the photo shown may not be one of the actual gun being auctioned. You can file a complaint with GB also. Going along with this seller's behavior only encourages him and others like him to continue the same. Will you really be satisfied with this pistol? If it were mine, everytime I looked at it I would be irritated that I had been misled/cheated.
 
I agree to a degree that I got the stinky-end of the stick but what must be remembered is that he offered me the refund as soon as I called him and told him the gun was not the same one pictured nor in anywhere near similar condition. I told him I'd prefer an exchange but he stated he only had regular 5946s which wasn't acceptable as I'm way too tactical for a regular one. I told him I'd be inclined to hold onto it then.

I then contacted S&W and found out there wouldn't be a charge for the rail attachment (which I still can't believe) and I'm pretty sure Brownell's has replacement grips for $15ish. I then called him back offering the 10% refund and ended up with 5% and I told him I'd settle for that and we'd be square. I believe in sticking with what I told the guy. It wouldn't be right for me to say "okay you've met my conditions now I'm demanding more".

I would also be worried about him being a regular scammer if his feedback wasn't as positive as it was. I think you could work that system to a degree but GB would catch it.

If he scammed me intentionally then I hope it was worth it to him but I've gotten over being upset about it and am now thinking how my lemon 5946 is likely on a plane somewhere scheduled to be in Springfield tomorrow by 3pm. I requested an estimate for parts and services to get the pistol in as close to just-left-the-factory condition as possible so we'll see what happens.

In the end you will probably be happy with the gun and the deal and that is what matters most.
 
Im going through a similar situation and it sucks.. I hope it plays out well. The seller, an online retailer, agreed to replace the gun I recieved and paid shipping back to him but I have to pay the FFL AGAIN when I recieve the new one.

Took 8 days to get it, some 8 days sending it back, another 8 if it gets shipped back to me ..so I paid for something almost a month ago for something I dont have. Hopefully the gun I recieve will be as described.

I have never bought something used on the internet but couldnt find a 3rd gen smith at the 4 guns stores near me. I wont be buying anything I cant see and touch again

I just found the same picture on gunbroker under the seller name " BARRIEGUNTRADER" That is A BUNCH OF CRAP! THAT IS FALSE ADVERTISING. It also said it was a police desk trade in.

Definately a scammer. Same exact picture, same story "desk cop's gun."

Just listed today. I would be notifying Gunbroker.
 
This seller is definitely scamming. He tells the OP that he doesn't have anymore of the TSW and there he is selling another one. I would complain to GB, but I hear they do not really do anything. Barrieguntrader is a rip off artist.
 
I saw "another" one listed a week later that used two of the same pictures and it was quickly Bought Now as well so I put a "Watch" on it. So you're saying he listed a third one?!!? I asked for an exchange and he stated he was out. If he's truly listing a third then he's an outright turd.

I wish they'd let me speak with the fellow that picked up the second one!

I may have to contact Gunbroker now, this is ridiculous. I'm going to dig around on the site and see who it is that should be contacted.

But still using the exact same pictures. Unreal.

I had asked him on the phone when I first contacted him regarding not receiving the correct pistol that he take new pictures of the exact pistol he's selling and he stated he would.

Some poor soul is going to bid on a TSW and end up with a standard.

Caveat Emptor to be sure!
