For military retirees

Are you a military retiree with a disability getting VA disability compensation? If so is your retirement reduced by the amount of the VA compensation. If so, and your disability was caused by combat, or combat related training, look into CRSC. Combat Related Special Compensation. If you qualify, all, or part of the VA reduction amount may be returned to you.

I am drawing disability for 2 incidents. One involved combat in Vietnam, the other, a parachute jump gone wrong. I was told about CRSC by a fellow Vet.

I applied and now have all my retired pay intact, plus the VA disability amount.

I hope this is an appropriate place to post this. I know many Vets frequent this board.

As I understand it... Retirement is adjusted only if the disability rating is less than 50%

My father in law is 100% disabled USAF retired . Up until some years ago , that's how it worked . The VA would take his retirement , then pay him . Finally , a law was passed , and that went away . He says it was like winning the lottery . He was an E-9 , over 30 . His life changed greatly when that happened .
 
I always thought that the disability you got was tax free which also reduced the tax on the remaining retirement pay you received. I receive no disability after 21 years just my retirement so never looked too deep into it.

I do have a hard time listening to friends who have 10 to 20 % disability due to tearing up a knee at a lunch time basketball game and bitching about not getting more.

My Buddy Milt was on partial disability.
He was carrying around some of that good old Commie Iron!
And his right ear didn't work that well.
A M1 was fired about 3 inches from it.
Not recommended!
Unless needed to save your life.
 
I was wounded serving in the Marine Corps, and went on to serve four years in the Army then in the Army National Guard. I have a lower % disability rating and that was taken out of my retirement pay. When I filed my retirement papers I also filed the CRSE papers with them. I waited three years but the Army was still taking my VA pay from my retired pay. I contacted my Congressman who said he would look into it. A month later I got the back pay the Army owed me. The Congressman later told me that it was rare to get it that fast, it normally took up to five years. Wow I said that's a poor reward for for almost 28 years of service.
It should be noted that this exemption only applies to those who were wounded in combat.
