After the killings around UCSB three lawmakers are proposing a "gun restraining order" to stop(?) the killings by people who might be mentally unstable.

Family members, partners and friends would have the ability to alert law enforcement if they believe someone poses a threat to themselves or others. Law enforcement officers would then be able to petition a judge to grant a restraining order that could prohibit possession or purchase of a gun.

My question is...Whose testimony will be the authority that decides whether or not your guns are taken from you? Will it be the vindictive neighbor who's lawn your dog dumped on? Will it be the exwife who decided you're not paying enough alimony?

The proposed law would allow authorities to confiscate any firearms you own for at least a year or prevent you from purchasing one if you are thought to be a threat to others.

It will be interesting to see if this proposal goes anywhere and also what the procedure would be.I can already see an increase in no knock raids and even innocent people being killed.

I don't think anything has been written yet and you can google it if there's any interest in reading about it.I just think it will be another disguised way to take guns from innocent people.

I think sometimes they pass these laws knowing fully well they will never make it past a high court, but do it and use it until it gets knocked down. It is just impossible to have a legal law where a layman can report you as "unstable" and have you rights taken away with out some kind of court hearing. To much he said she said. Lack of proof. My testimony to a persons mental state would probably not carry much weight in court even IF the court allowed me to express it in trial because I have no training.
 
The sooner these morons figure out its not the guns that are the issue but the mental health systems that is failing the sooner we will all be a lot better off.

The hearings aren't to prove you are a threat, they're for you to prove you're not. That's how restraining orders work. They restrain you immediately on someone's word, and you have the right to respond. They're holding your iron until then.
