I bought the last gun I'm going to in this lifetime

I know there is 11% excise tax on new guns. PSA will charge it for complete guns, but if you buy the gun in parts (and don't have all the parts shipped on one order) the excise tax does not apply. I have never been charged excise tax on a retail purchase. I assume it is already in the price. I would check with the manufacturer to see if the excise tax was paid. The $5 call sounds like "extra profit" to me. I would check with WalMart to see if this is their corporate policy. I have not bought any guns at WallyWorld, so I cannot tell you if they charge that in Asheville.
 
They tried pulling that **** on me. I told them "no way". That's my box and I don't want it damaged with shipping tape. Give me my money back if you're going to destroy my box. Manager carried the box outside the store directly to my vehicle and handed it to me....no tape! :)

LOL... why so concerned about the box??
 
The $5 is charged by florida Dept of Law Enforcement for the background check.... each retailer gets a bill each month for his background checks... thats where that comes from....


BUT---

In my years of working in a florida gun store we have NEVER EVER charged an excise tax (or been charged one from our suppliers!!!) Sounds like somebody is "creatively diverting money" ....

If there is an excise tax it is probably on manufacturer, who wil of course add it into wholesale price, where it gets rolled into the retail price.....

I would contact the Wal Mart Department or Store Manager to complain.... they should not have charged you that....






I understand the box, some people don't care, but if I pay for new I want new.... how would you like it if your new car had a bunch of door dings from the salesman slamming doors into it???
 
The excise tax is NOT collected by the store selling the firearm.

That is added on by the manufacturer or the importer..............

You need to go back to the store with some quotes from the

"ATF no longer administers the Firearms and Ammunition Excise Tax (FAET) provisions of law. That authority rests with the Alcohol and Tobacco Trade Bureau (TTB) within the U.S. Dept. of Treasury. "

and explain that you were robbed!!!!!!!!!!
 
I guess I am lucky. Our local Wallyworld refuses to sell guns, and except for shotgun shells has not had any ammo this year. So, I don't have to go through all that. If one has a CHL, they do not have to go through the background check thingie.
 
Yeah I remember saying this is the last one before myself. Caught myself in another lie.

As for the excise tax that's a new one on me. I've never been charged that at least not to my knowledge, it could have been added to the price and I didn't know it. I think you've been had on that one. I think I would go back and make them explain that one to me and show me some paperwork proving it.

I wondered if Florida was one of the POC states, thus the fee.

Some states use NICS directly (like Ky thank goodness). The dealer calls the FBI/NICS directly, no charge.

Some states are " Full Point of contact (POC)", which means they have a state office that you call and they interface with NICS. Looked it up out of curiosity, Florida is full POC. They handle all the checks. Some are Partial POC - split depending on whether it's a handgun or long gun purchase.

I assume the fee, if any, is set on a state by state basis. Supposition on my part, I'm just glad Kentucky lets NICS do it all.

Also I see on the site that Florida's carry permit isn't qualified as a background check replacement. Kentucky's is, which means anyone who buys a gun here with a cc permit we don't have to run a check at all, just put down their cc permit info.


Re the excise tax, dealers do not collect nor remit that tax and like autococker I've never heard of such a thing either. Maybe OP was just frustrated over the total tax bill which includes taxes he didn't pay in line item fashion but were built into the price. I can't say I disagree, when you add up all the hidden taxes we all pay it's a huge number.

There are a fair amount of hassles at times buying a gun or otherwise jumping through the government hoops, and the anti-gun folks hope all those hurdles convince people to not own them or fool with them. We can't let those people win. So do their paperwork, fill out their forms, take your gun home and ruin their day.

I as know it...

the excise tax on a gun is paid by the manufacturer.. and passed on to the dealer WITHIN the cost..as charged to the dealer..( Even then it is not " broken out")

The exception is a sale to LEO through the LEO purchase program for duty..

Example..

A Glock cost is $500.00..( WHITE LABEL)or ( RED LABEL) the dealer sells it at 15% over @ $575.00

An LEO purchase program dealer will purchase the same Glock ( BLUE LABEL/LEO) for $500.00 less the 11%
$445.00.. and sold to the LEO for $500.00..Or a customer at $550.00

That is why so many dealers are pissed off at the LEO dealer for selling the Blue Label Guns at retail and cutting everybody's retail price..

Your experience at Wally world seems like there is more to the story on their side.. Where did they get NON EXCISE TAXED GUNS that they are charging the customer??
 
How much was the gun? That sounds like the tax on something 3 to 5,000 dollars would be. What am I missing here?
 
Jeez, dogpile.
1) I know the manufacturer pays the 11% excise tax. If'n they didn't I bet the gun would be that much cheaper.
2) Yes I did sign electronically.
3) We have FDLE checks at $5 a pop everywhere I've bought a gun from an FFL except this time.
4) I have not exceeded my "monthly griping bandwith allowance" (MGBA in .govspeak) hence the OP. Joe
