No, you are not allowed to give the firearm itself. You can purchase a gift card to the gun shop and give that as a gift, but you can not purchase a firearm and then hand it to someone else, gift or not.

I would advise a person to check with BATF and their state/local laws. What you stated is not necessarily factual depending on jurisdiction.

A very good point, I stand corrected.
Based on my home State of Ohio, what I said was true.
Your state may be different.
An excerpt from the blog you referenced though does support my gift card suggestion statement;
The ATF recommends that if you want to give someone a new firearm, rather than going to a gun store, buying it on your own and giving it to, say, your father, consider instead purchasing a gift certificate from that retailer and giving that to Dad as his present.
Received my wife's back today. The paperwork says all they did was replace the magazine. WTH?

do they have the dimples on the right side mag slot?
Did you shoot ball ammo, or did you use your self defense ammo? My 7 round mag wont drop with ball, but with various SD ammo the mag drops very often to almost all the time.
are you saying that you can't buy a gun and give it to a friend as a gift?

Finally heard from S&W.....
4 business days after my initial email, finally heard from S&W concerning my 40 Shield s/n DXY**** mag drop problem - "Send in the gun"..... I've already dimpled the mags with a punch and that (apparently) resolved the mag drop issue (100 rnds w/o failure). However, in case they are replacing the mag catch (as I've seen in numerous posts), I will send it in anyway. I've also discovered the front roll pin tends to walk out under repeated firing (75 rounds). Have asked that to be addressed as well.

I have experienced the problem with the extended mag in my 40 Shield. I haven't had time to do any further testing, but appreciate the info. Blitzfike

My sn is DXX---- I don't have dimples on either of the mags but will have tomorrow. No sense in sending this to S&W, a proper mag catch/release would fix it as would a better fitting mag, but as long as the dimple fixes the problem and it continues to function as well as it has when it works, I'll be satisfied. I have an XD sub compact in 40 and other than its clunky thickness, I like it very well. The Shield is a better fit for me as a concealment weapon. In two months we will have open carry with a CCW license so size won't be as much of an issue. As of now, if it imprints it is illegal.. I plan to still carry concealed even after that... take note of what i did with the tape... that helps to... in OK you need a ccw for open? that sucks... you dont even need a CCW for conceal in AZ...

Yes, that is exactly what I am saying.
Here is the entire paragraph from the blog previously listed.

That way he’ll get exactly the gun he wants, and there’s no question about who is “the actual buyer of the firearm,” which is a question any purchaser must certify on the Federal Form 4473 at the time of purchase.
If the person receiving the weapon is not the actual buyer, then there is a problem with how you answered the question on the Federal Form. You might want to reconsider "picking one up for a friend" until you have had time to consider the Federal, State, and Local laws, and their consequences.
Personally, I wouldn't do it for family, or friend.

The problem is insufficient engagement between the magazine and the mag catch. A new, larger mag catch might fix the problem. A new magazine with a "bump" seems to fix the problem for those who have received new magazines. Anything that increases the amount of engagement will probably work.
S&W's approach seems to be disturbingly ad hoc. Some people get new mag catches. Some get new magazines. They need to get their act together.

I’m not a Shield owner but as a M&P owner feel unhappy for what’s happening with the .40 S&W Shield. I suggest writing an email to S&W and giving them a link of this tread to let them know how many customers are complaining about this ”mag drop” issue. Worst case scenario they will no look at it but maybe, maybe they will see that this is a real problem and take this thing more seriously and give a solution like a recall or a new mag design.

I belong to multiple online gun forums and have read numerous accounts of other shield 40 owners who have warrantied their pistols through you for this exact issue. They recieved modified magazines and an updated mag catch. Their problem seems to be solved.
I would like to request the same service for my problem. I can send you my mags for modification or you can send me modified mags and the new and improved mag catch. I can install it myself.
I would prefer to receive the items in the mail and not mail my entire pistol to you. Mailing the pistol to you is unnecessary. I thinking mailing a pistol and magazines together is a huge potential liability on me as the owner if it were to fall into the hands of a violent criminal.
I own 4 Smith and Wesson pistols, I recommended the shield to two friends who also purchased Smith and Wesson shield pistols.
Please advise.
