Multiple Handgun Purchases

The title is slightly misleading. I recently picked up a S&W 686 as I wished to add a wheel gun to my collection of handguns. I am also switching my EDC from a Springfield XD9 to a FNX40. I filled out the form for the 686 on 3/1. The shop is open four days a week. My FNX40 is scheduled to be delivered to a different shop, closer to work, on 3/9.

Will filling out the form for the FNX40 require me to fill out a multiple purchase form?

Answering the door for the BATFE is not my idea of a good time even when no laws have been broken.

It is the dealer's responsibility to fill out multiple purchase forms per BATFE instructions, not yours. I don't follow your logic on why you think your single purchases from different dealers a week apart is a problem. Are you in a state with additional rules, like CA?

The Gun Control Act (GCA) of 1968 requires federal firearms licensees (FFLs) to report multiple sales or other dispositions of handguns to the same purchaser [18 U.S.C. § 923(g)(3)]. The sale or disposition of two or more handguns must be reported if they occur at the same time, or within five consecutive business days of each other.

Reading the ATF's regulations left me scratching my head but deciphering regulations is not my strong point. So I guess as long as I pick it up on or after 3/10 I won't have to fill out the multiple purchase form.

Well, I've told you your interpretation is completely wrong, and you apparently don't believe me, so all I can suggest is call the BATFE office nearest you.

Can you point out where in my previous post I questioned the veracity of what you said? Re-reading it all I stated was: I am bad at reading the bureaucratic language and that I will just pick it up on the day it is scheduled to arrive since you said there wouldn't be an issue.

So... yeah. Nothing there about disbelieving or discounting your advice. I am taking it, as a matter of fact.

The more important question is, why the switch from the XD9 to the FNX40?
 
I'm confused. You already picked up the 686 correct? It's in your possession right? If that is correct then you are not buying multiple you are buying the one...the FNX. If you were buying multiple then you would be buying the FNX & 686 at the same time from the same store.

And the ATF doesn't show up to your house just cause you bought 2 a g once. I mean they can but I've never heard of this and I know people who have done multiple purchases on multiple occasions. I even did it once. Bought a Browning 22 handgun and a Savage 32.

As stated above- completing the ATFE multiple purchase form is the responsibility of the FFL where you take possession.

Taking possession is the issue, not purchase. If you pay for two handguns on the same day, take one home that day, return 7 business days later and take possession of the 2nd there is no requirement for the multiple purchase form.

When your FFL receives a handgun you got on the forum or an auction site it is already "purchased". The FFL is transferring it to you & you are taking possession.

If you take possession of two handguns from the same FFL within 5 business days [Mon-Fri; weekends not counted] the FFL has to fill out the form on you. "Simple" as that.
 
Twice now, since June of 2013 (when I took up residence in MA) I have purchased two handguns together...At the same time. Payment in full for the purchase(s) by one check. Only one LGS mentioned having to report the sale...And I could not have cared less. BTW, both sales were two weeks apart.

Now y'all got me thinking. Should I expect a visit from the "G"? It has been years since I have bartered in firearms, did I do something wrong? Does it matter that I also sold two handguns (trade-ins on the sale) at the same time? I also purchased 1000 rounds of bulk range ammo for use as I learn to shoot my new guns, is this okay? Or am I going to be identified as some sort of threat to the town I live in?

Wholly shat, what have I gone and done now?

To answer the OP's question - two handguns from two different shops transferred more than five business days apart prompts absolutely nothing. Multiple transfers on the same day (the most common situation, unless you like to commute to your local dealer) prompts the dealer to fill out the form. You would have to do that multiple times to draw any attention from anyone.
 
On one of the Pennsylvania firearm forums, there is a very wealthy man who also happens to be a gun nut. Basically put, if he likes it, he buys it. I think his thread was deleted on the forum as per his request, but he owned hundreds of guns. One day he was visited by the ATF because he buys so many guns. They had a very strong suspicion that he was a straw purchaser. He gave them permission to do an inventory of his gun collection, but after that visit they have left him alone. The ATF basically now knows he is a wealthy man with a gun collection that would make the NRA blush.

I don't read regulations, I buy guns. If the BATFE or anyone else has any problems with that, I reckon they can come see me...my address is on the 4473.
 
I really like my FNX40, but it's too big for EDC unless it's full on winter ( for me anyways) As far as multiple gun puchases; that reminds me of the time I got a phone call from the Kentucky State Police (many years ago) telling me to take my newly purchased handgun back to where I bought it or face an arrest. Now I'm wondering if it was the dealers fault for not filling out the proper form. (multiple purchase senerio) I never did figure that issue. The whole story in on here somewhere, but I agree with everyone else else; nothing to see here folks , move along.
 
I have had ATF visit my home twice. Once the visit was prompted by a multiple purchase form sent to a local sheriff by my dealer FFL. The other visit was bogus and I won't bother with details. In both cases the agents wanted to see my guns. My response was "I will call my lawyer and then we will work out a way to satisfy any concerns ATF might have". In neither case did ATF get anywhere near my gun safes.

If you think lawyers are too expensive and you can handle ATF on your own, good luck.
 
I am big believer in using the rules against the rule maker itself, it's a great form of juijitsu. Perfect example above. Always make those that make the rules go through every hoop and step and follow there own bovine droppings to the letter. Eventually it will wear itself down.
