I have heard that S&W has determined that all NM3 frames were manufactured before 1899 and are therefore considered antiques under Federal law, regardless of the date they were shipped. Is this correct?

Yes, that's absolutely Correct!! All S&W #3 Lg-Frame Top-Breaks regardless of Model, (Single or Double-Action), are considered to be Antiques!!
 
They are antiques only under the Federal BATF regulations. Those regulations may, or may not, apply in various US States or cities, nor in any foreign countries. For example, in New Your City, Washington DC., and California, only passing recognition is given to BATF rules and if a gun can chamber and fire modern ammo. (As most NewModel #3s will) you can have a legal problem transferring a gun as an antique if the authorities want to hassle you. Ed.
