It's certainly a disappointing development, but it's not the end of the world. Peruta is still floating around in the 9th circuit awaiting a decision on an en banc rehearing. If granted, that will extend that case by a year or more. If the 9th declines a rehearing, the state will have to decide whether or not to petition for cert. to SCOTUS.

There are three other cases at the District Court level that address the same issue. The problem is that it will be years before they complete the trip through their respective Circuits and even get to the SCOTUS level. One of them is a DC case that has been sitting awaiting a decision since 2009.
