open carry rules????

hey, hows it going everyone? I am stumped. its a rare occassion, but my friend has me tonight. I cannot find any literature on whether or not you can open carry in a bank? its not a federal building, but it is federally insured? he says no, but I think it is one of the most probable places to run into "that" situation, and frankly I am not going to become a hostage victim awaiting my rescue or departure! I have been carrying in the bank, but I usually throw my jacket over it so as not to become a grab n go target while in line(I have a ccw also, just prefer oc). maybe they just havn't noticed it, I cannot be sure. any first hand knowledge, or a friendly nudge in the right direction would be greatly appreciated. looking forward to the thread. seeya on the other side!

What state do you live in? A bank is the kind of place where you're likely to walk into a robbery in progress and depending on your locale, you may draw unwanted attention.
 
Depends on state law.

In Nevada,there is no law against open (or lawful CCW) carry in banks.

I tried OC in my bank. No one noticed. Finally, I went into the manager's office to ask a financial question - she too didn't notice.

Finally I asked if they had a policy on OC. She said she knew it was legal and didn't really care but the unwritten "policy" was they preferred you didn't OC - but lawful CCW is perfectly fine with them.

THAT is something I can live with!
 
State laws vary so you should read yours to be sure.

Here in my state, a bank has to be properly posted to be off limits.
 
Occasionally there is a dense, ignorant individual that simply does not understand that "Federally Insured" does not make a bank Federal property.

Banks (unless you are talking an actual Federal Reserve Bank) are NOT Federal property nor subject to USC restrictions on firearms on premises, even if their deposits are insured by the Federal Deposit Insurance Corporation.

Here in Ohio banks are not off limits unless the bank itself posts it so. You can pay attention to it, or you can play by big boy rules.

easy there fella. I hope your not referring to me with that! for friends sake I will assume you are not. big boy rules? well, I am a gunsmith and own a small gun store in wyoming. if I violate the law and get convicted, my livelyhood is over, so I am very interested in knowing the EXACT laws and obiding by them, big boy or other.

I am talking about your friend. The one who thinks carrying in banks in somehow prohibited by Federal law. Banks (except for Federal Reserves) are NOT Federal property and federal laws regarding firearms do not apply.

If Wyoming prohibits it, it will be somewhere in your state code, probably right along with the rest of your firearm statues.

You can carry in banks in Wyoming since there is no explicit prohibition against it. I also do not see any allowance for private business to prohibit the carrying of firearms on their premises, so ignoring a sign is probably just a trespassing infraction if you do not leave.
 
yeah, a business can ask you to leave, but that is it. I looked there first thing, but when I did not find anything specifically on banks, I thought I'd throw it out here and see what the community had to say. gotta love wyoming. thanks for the input
 
We have open carry in South Dakota...no restrictions in banks. What's interesting about our open carry law...if more than 1" of the gun is visible, it is considered "open carry".
 
Ky is the same ....... banks are legal to carry in. If they have signs saying " no deadly weapons " all they can do is ask you to leave if they see your weapon. I think the only place I've seen no weapons signs around here was at kentucky utilities. (and I always obey them

To the best of my knowledge, none of the banks in my town is posted. Certainly none of the ones I've visited for personal or company business have been.

N C Specifies "financial institutions" which I would understand to include loan Cos. and Banks and places like brokerage firms. They are all NO carry places.
 
I know you're specifically asking about the legalities but I'll throw this out anyway. I wouldn't be in too big a hurry to open carry into a bank. If someone did come in to rob it while you were there they'd probably shoot you first. I don't believe open carry should be restricted but I don't think I'd do it that often. Actually, I can legally open carry right now in Texas but I only do when I'm working and then it depends on where I am going and for whom I'm looking.
 
well, I don't know about anywhere else, but here in wyoming, there are NO open carry laws. none. it is not mentioned at all. stare decises has indictated that this means you are allowed to open carry ANYWHERE, with few exceptions. you do have to fallow federal law, therefore federal property is off limits. other than that, private property right dictate that someone can put up a "no firearms" sign, and you would be required to cc. but when it comes to oc, banks, bars, stores, police stations, are all fair game. I have carried in all these places, and had no trouble. a few leo's have asked me about my piece, type and preferance, but thats it. thanks for the posts
 
....know your state laws. NE law prohibits concealed carry in "financial institutions" as well as many other settings where an individual might feel inclined to want to carry.
