Peruta reversed

Heller vs DC and McDonald v Chicago all ready decided the 2A applies to outside your home too. Peruta v San Diego will get overturned like Caetano v. Massachusetts was overturned by the Supreme Court.

Also it was on May 17th of this year, a DC federal appeals judge said the "good cause" requirement of DC's application for concealed carry license is likely unconstitutional.

District Judge Richard Leon, a George W. Bush appointee, said the city’s requirement that applicants prove they have a “good reason” to carry a firearm beyond self-defense violates the Second Amendment as interpreted in the landmark Heller decision.

I love the "good cause". What is considered a "good cause". Do I have to be mugged? More than once? What if I just work in a very bad area but have never been targeted? Is that not enough cause?

Depending on how far left you are, after 10 consecutive times being raped you could possibly claim "good cause". They also assume automatic "good cause" after the first time you're murdered.

I figured that murder would probably be at least 70% good cause. I can't say 100% because we'd need to hear the murder's side first. It could turn out that he was the true victim. I'd say rape is 50/50 at best depending on the financial status and racial makeup of both parties.

I believe that if this goes to the SCOTUS, and a 4x4 split occurs, the ruling of the lower court stands...Maybe one of our attorneys will chime in????

I'm not an attorney but that is correct. I dont think it would be a good idea to appeal this case to the supreme court while there are only 8 justices and where the vote is most likely to be a 4-4 split.

By the time this reaches the SCOTUS, we will likely have our 9th Justice, therefore, no 4x4 split.

Best,
Rick

Hasn't the 9th Circuit just hoisted itself on its own petard??
The Supreme has found that the 2nd guarantees your right to bear (carry) arms outside your home. Now the 9th says you can't carry concealed. I guess that leaves only open carry, which I thought was not currently legal in much of CA....?????????

The Supreme Court has NOT decided the 2nd gurrantees you ANY rights outside your home.

Scalia flatly said legislatures can and do make laws regarding guns.

He also flatly said the Assault Weapon ban was constitutional.

The 1994 Assault Weapon ban was upheld as constitutional as are NY and California laws.

Bluntly, this a horrific setback. And the likely outcome is the US Supreme court reaffirming legislatures can make laws restricting carry outside the home and the 2nd amendment does NOT gurrantee this right.

Amazing i
