First I am glad are safe, no one hurt this time.

In reading your original post, it appears that you were only person to provide a statement to the deputy.

If that is correct, then you truly have a "he said/she said" situation. Doesn't make it right but that is the way it is.

If your partner witnessed the incident, he should have been interviewed as well. A witness to the incident lends more credibility to your accusation.

I can understand your frustration. Believe me we run into these situations regularly and only by the Grace of God are many folks spared, so it seems.

A camera kept available is a good option, continued documentation of her behavior by the course is crucial, as far as being armed is a very complicated decision that is best determined under the most peaceful conditions.

I'd be in the county attorney's office for an explanation.
With 4 witnesses to multiple felonies it sure seems like something else is going on....

On edit: I would also ask for all paper work associated with this case. Could be that deputy isn't telling you the whole truth.

I got the call last night from the deputy who had initially responded. Based on his investigation the County Attorney does not feel they can get a conviction so the case has been closed. That's it, nothing, zip nada, basically it never happened. I am a little calmer this morning, you would not have wanted to read the rant I contemplated last night. She committed two counts of felony aggravated assault and got away with it. I hope that there are no further incidents involving this psychopath but if/when there are, the Pinal County Sheriff's department is going to have a lot of explaining to do. I have always had the utmost respect for LEO's and the difficult job they do but this guy blew it. I'm going to stop right here as I feel a rant rising.
If were you, if she goes on to maim or murder someone, I'd be available for anyone who wanted to interview me on camera, from the local highschool English class to Fox News. I'd say what happened and name names. I'd make sure that the entire world knew that it could have been prevented and I'd provide the documentation to prove it.
 
We lost this one because the responding deputy had a bad day and bungled the call. Without interviewing my partner, (I asked three times before he finally spoke to him), he had made up his mind that my report wasn't credible and wasn't about to admit his error. I still don't see how his supervisor and the county attorney, could ignore our two identical written statements as to what happened. I asked the deputy point blank (pun intended), if this lady and her husband were in the witness protection program given the free ride they were getting. His only response was a very long pause....hmmmm, makes one wonder does it not?

Sadly, while I still respect LEO's and the difficult job they do I will be very wary in any future interactions. We were victims of a violent, unprovoked crime and did nothing more than accurately report the facts. She walked away clean and is probably laughing her ass off at making fools of us all. If/when she goes off again and I'm betting it will be when, not if, rest assured I will be retelling this tale of bungled justice and the Pinal County Sheriff's office will have a lot of explaining to do. Oh well, one more shift and I am off on vacation and it could not come at better time. BTW: Thanks to one and all for your concern, advice and support, it has really meant a lot to me. (o;
 
Steve, I felt the same way you do when I went through a nasty divorice. Its a combination of a crime or incident being so hard to prove with lack of hard evidence, overloaded calls, overloaded court system, deputys or investigators "loseing the moment" that its a real mill! I still get mad when I even think of what I went through in my divorice 25 years ago, and I am sure many other people felt the same way in theirs and also people that have been in incidents like yours.
Bottom line. If there is anything close to real fair justice I honestly belive its by accident! We just have to wait for the great white throne for it. Its really a case of they will get theirs, in the end!
 
Gee whiz--that's a "hazard" that isn't typically described on any score cards! I think you handled it as well as you could, that this likely will happen again, and I hope next time they will at least arrest her. Some sort of camera would have been a nice addition to your bag, tho' I don't think too many golfers carry them. Sure would have ended the whole "he said-she said" aspect. Otherwise, best you can--play on!!
 
i think if the woman had a gun tracking at my head,i'd be screaming,running the zig zag weave,heading straight for the woods,where i could quietly clean out my shorts.later i'd go back and whack her with a three iron.you don't mess with a guys golf game!!!

Ah the memories...In hindsight, which is always 20/20, I should have at least whipped out my cell phone and tried to take a picture. I wasn't carrying so our only option was to flee. This idiot still lives there though their house is, and has been for sale for a year. The whole community has heard the tale so everyone is cautious anytime she is around. A couple of her neighbors have come to me and admitted they have seen the rifle in question, the one they don't own. When I play the hole next to her house I used to ask my playing partners to watch my ball, now I just ask them to "cover me". (o;
 
I read this and think of the scene from "Happy Gilmore" when he first tries hitting the golf ball and takes out the guy as he comes out of his house 400yards away, then knocks the guys wife out of the upstairs window on the next drive...maybe you just found the real-life people behind the movie!
 
If some one is pointing a rifle at me the last priority is reaching for a camera. You are literally in mortal danger and the time wasted taking pictures might cost your or your buddies life. If you cannot engage, unassing the area is the first priority. Lingering to take a photo may just escalate the nut job into pulling the trigger. You did the right thing for your circumstances.

As a retired thirty year cop I think that deputy has some explaining to do. This was a felony assault with witnesses and should be charged as such. If this had been one of my officers I would appreciate a heads up on their inaction.

An aside, many of us assume that we can't engage at forty yards with a handgun. You should practice once and a while at longer distances in the event you have no other choice. Most self defense shootings are at arms length and most recent training discarded longer range shooting. This resulted in many shooters having the mind set that a handgun is useless at ranges longer than twenty five yards.

I ran a yearly one hundred yard training with my officers to show that they could make hits at that distance with a handgun. I never had anyone unable to hit the silhouette several times per magazine at the longer distance. I don't recommend taking on a rifle with a handgun but it beats taking a 30-30 bullet in the back.
