I understand what you're saying but we are talking about two different things. You're talking about the process of making law and I'm talking about enforcing law. An ATF agent's duty is to enforce USC when it comes to importing firearms and the Constitution is not relevant. The OP was talking about enforcement, not formulating law.Thus, ultimately the Constitution trumps everything--including the United States Code.
