Denied purchase of a Hand Gun. :-/

The store does not have to call the NICS system if you have a CHL Permit. Were you meaning to say you had such a permit when you said "CCW"??

if your name matches anybody with a record, they will either put it for further review, and the person calling the NICS will be sent to somone else to do a lil check and often let the deal proceed----if that agent can't clear it up quickly, (via whatever records or computer they are looking at) they will delay it. Common names do not help you in this regard.

As for you being ticked, I AM TOO!!!

In Florida, a permit to carry a concealed weapon is referred to as a CCW Permit. A CCW permit holder is not normally required to wait and can take the new purchase home. The background check is still required. I was mistaken in my OP by using the term denied. As others have corrected, my ability to take my new gun home was delayed. The store is thirty miles south of me and the owner & men who work there are great people. Thanks for being "ticked" with me.

I was a Florida resident until a year and a half ago.
Born in Florida, served eight years military and 45 years Law Enforcement in Florida.
In Orange County there is a Black Male (I am a White male) that has the same name as mine. We have different birth dates, social security numbers, and live in different parts of the state.
I have and still do get "Denial" on firearm purchases, job applications, etc. because of this. This "Other Jimmy" has a history of "Domestic Violence" arrests and is currently being arrested quite often for this offense. Approx every 90 days the State sends me a letter stating my CCW has been suspended because of "Domestic Violence".
The State of Florida uses the "Soundx System" and every person with a name close to the offender's gets a "Red Flag".
This is what could have happened to you.

I don't know if Florida is different, but here in Texas, if you have a CHL, they don't do the check.

The good news is, it is a delay and not a denial. While frustrating, you will get your gun.

I live in Jacksonville, and have never had a BG check done after receiving my CCW.
 
in the past year ive been delayed twice out of six purchases. happens sometimes. i had to wait 3 business days each. don't worry the dealer will hold on to it, till its cleared. you should of seen the stack of receipts my lgs had with delays. about a inch thick. nothing like slappin $700&change on the table on friday night, & leaving with a receipt saying come back on thurs morning to pick her up unless we call you. yeah it pisses me off, but hmm...

I have always thought that in Arkansas if you had the concealed carry license that they did not need to call, but I have only bought shotguns since I got mine and I dont think the dealer ever called anybody. Jeff
 
In Mississippi, you fill out the necessary forms, include your carry permit number, I never give an SSN, and you get your gun, no call or anything,. They do make a copy of my carry permit card, but that's all.
 
If I have the OP's name figured correctly, does that mean the Governor of California would get the same treatment should he decide to buy a handgun?

Well, as an aka yes. But my given first name would make it difficult for a certain rock/soul performer to purchase, if he were still with us. "I feel good."

Two people I work with-both with secret clearances-both with CCWs-were denied purchases. Contact the NRA, ask for a congressional investigation. Do not let it go-I would even consider a lawyer. This is a criminal act by the federal government.
 
did you really expect the government run operations to do quality checks on there work flow process and strive for excellent customer service and follow through???

Welllll It's not the federal Government here. It the STATE Florida Department Of Law Enforcement.. and EVERY purchase through an FFL must be run through the FDLE..

He was NOT denied.. just delayed.. and even if there was a denial..( Non Approval) there is an appeal form..

If you buy a gun from a Florida FFL they are required to make the call to FDLE..and the approval number noted in the space provided on the 4473.. section 19B There are no exceptions to the procedure.. or your FFL is in violation of Florida law at least..

Private sales are exempt as guns are considered " Private Property" no different than a lawn mower..

I hope your FFL is following procedure..:eek:

Shrug. Try Armslist et al if you don't like paperwork. You just hand some guy money in a Walmart parking lot. Downsides of course are limited selection and not knowing where something came from.
 
Being delayed is just one of those minor inconveniences in life. It could have been because of the workload. Take a deep breath. Count to ten and go back in 3 business days (holidays and weekend days don't count) and pick up your gun.
 
It's not that rare. I have bought several C&R type revolvers from a retired cop who shows up for most of the local gun shows. He told me he was once put on hold, before he retired. I've been held up once. WTH if they won't let a cop buy a gun my feelings arn't hurt too bad.
 
Ah, government rules and regulators.

Let's see, a guy with a license to carry a concealed handgun is delayed or denied the purchase of a new pistol. So, he walks out of the store with a concealed handgun on his person. Oh yeah, everybody ought to feel safe now! :rolleyes:
 
If you are ever denied or delayed, either by a State check or a Federal check, and it is recommended you get a Unique number" then fill out the paper work and get your unique ID Number.

Apparently there is a "person" not qualified to recieve a firearm with a name/birthdate similar to yours.

Once you get your "Unique number", when a firearm purchase is called in with your name AND you Unique identification number, you should not be delayed/denied.

In Texas IF you have a CHL the dealer does not, and will not call into the NCIS instant check...
