Washington—Senator Dianne Feinstein (D-Calif.), author of the 1994 Assault Weapons Ban that expired in 2004, announced on Sunday that she will introduce updated legislation early next year.

“On the first day of the new Congress, I intend to introduce a bill stopping the sale, transfer, importation and manufacturing of assault weapons as well as large ammunition magazines, strips and drums that hold more than 10 rounds,” Feinstein said. “I am in the process of gathering support for the bill in the Senate and House.”

“I have been working with my staff for over a year on this legislation,” Feinstein added. “It will be carefully focused on the most dangerous guns that have killed so many people over the years while protecting the rights of gun owners by exempting hundreds of weapons that fall outside the bill’s scope. We must take these dangerous weapons of war off our streets.”

Since gun control proponents have repeatedly said that the previous AWB didn't go far enough, they will work hard to get it "right" this time around. For starters, no more "military features" like flash hiders, collapsible stocks, pistol grips and bayonet lugs. The last time around, manufacturers were able to change cosmetic features to comply with the letter of the law. This time around I also expect lawmakers to mandate changes in functionality as well. There will be a ban on the manufacture, sale or transfer of high capacity magazines and a California style "bullet button" intended to hinder quick reloads.

How many GOP and pro-gun right DEMS will roll over?? My concern is the GOP is already trying to change the face of the party to fortify their base so will the theme be "if we roll over on this issue we'll look more "cooperative"".

I have a hunch that the price of ammunition will skyrocket to even more ridiculous prices.

When laws are written and interpreted with a mindset of "what the definition is "IS" is" and when the head of the Dept. of Transportation can deny "having" a car because he did not "have" one in his possession in the Congressional hearing room (while owning a top of the line BMW), and the Speaker of the House can state " We'll have to pass the bill in order to find out what's in it" we are in the hands of the Philistines.

It will be interesting to see how many members of Congress with reliable pro-gun voting records are swayed by public pressure in the wake of recent shooting tragedies. The Senate is a lost cause, only the House can stop this latest push for "comprehensive gun control"...
 
Maybe I'm naive, maybe I'm blind to the writing on the wall, or maybe I'm just not politically astute enough.

But I just don't see that there are the votes in Congress to pass significantly more restrictive gun control measures. I also don't think a Presidential order, or bureaucratic or administrative actions would be viable in the face of such massive opposition to further restrictions.

Sandy Hook certainly has been a watershed event on its own, and even moreso when coupled with Clackamas, Aurora, and the Arizona events this year -- not to mention, now, the upstate New York ambush.

But even in the face of all of this, I don't think there is enough political will to do anything more than, perhaps, make cosmetic changes to Federal firearms laws. I don't see a reinstitution of the ban, certainly.

Not that I don't wish that there was a way to keep weapons of all kinds -- from long guns to pistols to edged weapons to fertilizer-and-diesel-fuel -- out of the hands of the mentally ill, the homicidal, the terroristic, and the criminal. I think we all can agree on that.

In the meantime, let's all on both sides of the issue keep the dialogue respectful, reasoned, appropriately volumed, and, if we can manage it, flexible enough so that both sides can acknowledge the strong points of the other's arguments.

There's work to be done here that can be beneficial to all of us as Americans, if we will all just try to be the kinds of citizens the Founders trusted we would be.

Let's try to rise to this occasion, folks, and find common ground that would help prevent in the future the kinds of things we've seen way too much of lately, while preserving the rights guaranteed by our Constitution.
 
I so hope I am proven to be wrong, but I can see congress jumping all on board some gun ban nonsense precisely to avoid dealing with the real problems facing this country. Time and again we have seen both parties pull this type of stunt to shift the focus from a serious matter to something that is much less important.

Insofar as a retroactive ban is concerned, and the constitutionality thereof, take a look at what has happened with the Lautenburg domestic violence statute.

National FOID card

Mandatory mental health checks of an arbitrary nature

Ban on sale of centerfire handguns of greater than 32 caliber

This is a REAL concern. How many first time owners will try and use them for home defense not knowing that ammunition choice is critical! Wondering how many bought m855 ammo that will shoot through bad guys...as well as walls and neighbors houses. It is a scary thought. This doesn't even address them accidentally shooting themselves or other innocents because they have no concept how to safely use one. How many will just read the manual once load the firearm put it in the closet and never practice? Frightening.

Misinformation. An AR is no more dangerous than any other rifle. Stating that some new folks just cannot safely have them plays right into the hands of the antis. All standard 5.56 including GI green tip is no more - and many times less - over penetrative than common pistol rounds. Anyone smart enough to fill out their name on the forms is likely able to understand an AR manual or they can download the Army one which has even more picures.
 
Feinstein and Cuomo are working on a mandatory gun confiscation and buy back. $500 was noted as a price "you cannot refuse". On the internet type in Feinstein gun confiscation.

Bans the sale, transfer, importation, or manufacturing of:
120 specifically-named firearms
Certain other semiautomatic rifles, handguns, shotguns that can accept a detachable magazine and have one military characteristic
Semiautomatic rifles and handguns with a fixed magazine that can accept more than 10 rounds
Strengthens the 1994 Assault Weapons Ban and various state bans by:
Moving from a 2-characteristic test to a 1-characteristic test
Eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test
Banning firearms with “thumbhole stocks” and “bullet buttons” to address attempts to “work around” prior bans
Bans large-capacity ammunition feeding devices capable of accepting more than 10 rounds.

Protects legitimate hunters and the rights of existing gun owners by:
Grandfathering weapons legally possessed on the date of enactment
Exempting over 900 specifically-named weapons used for hunting or sporting purposes and
Exempting antique, manually-operated, and permanently disabled weapons

Requires that grandfathered weapons be registered under the National Firearms Act, to include:
Background check of owner and any transferee;
Type and serial number of the firearm;
Positive identification, including photograph and fingerprint;
Certification from local law enforcement of identity and that possession would not violate State or local law; and
Dedicated funding for ATF to implement registration

It appears that any rifle with a detachable magazine that has one "military characteristic" such as a pistol grip, flash hider or other muzzle device, or a collapsible/folding stock would be an "assault weapon."

And take special note of the part in bold. Gun registration on a national basis.

Go to the news today boys... NO AR used in Sandy Hook shootings. All pistols. The rifle was left in the ***'s car.

Maybe just maybe the cops lied about the weapon used to further a political agenda. All we have to go on is the "official" story that the Bushmaster was used. If it had been the Glock or Sig there would be no call for a ban on "assault rifles." I'm not a conspiracy nut but you can't rule out that the police caved in to the feds.
 
Ahhhh but the truth is out now before the ban has gained traction
