CA - Roommate is a felon question

Your friend needs to let his big head do the thinking, and ditch his sleazy liar of a girlfriend before she turns on him. End of problem.

Now hold on. That's very presumptuous. Making a comment like that insinuates that people cannot change or learn from their mistakes. Also it assumes there is more risk here than reward. I don't believe one can make such a decision from the information provided here so far.

Here's the situation.

A guy has a girlfriend that has been convicted of felony perjury.

She lied to the police on several occasions regarding facts surrounding a guy that had allegedly been stalking her. The guy spent four months in jail and later had all charges against him dropped.

Because of her actions, she got sentenced to an equal amount of time.

The judge, and her attorney, are BOTH telling her boyfriend he needs to get rid of his LEGALLY owned firearm - they live together.

I've tried to look this up but my eyes were starting to bleed.

Can the boyfriend be REQUIRED to dispose of his firearm? Can it be turned over to someone else (me) for safe keeping providing I were to notify law enforcement (in writing) I am holding it?

Would I somehow be in violation of the law for doing this? This is in California.

Any link to a "reliable" site would be appreciated.

Assuming that your friend bought the gun in CA, it’s registered. With the anti-gun climate in CA and the little brown thing’s goon squads running all sorts of database cross checks to confiscate legally owned guns, all it would take is something to show up that… Oh there’s a felon and a registered gun with the same address, let’s go get’em!

Or, if he's that gullible, consult counsel & tread lightly. He's technically not in violation as the 'convicted felon' status is for her, but they reside in the Peoplz Republik of Kalifornia & he may find himself on the wrong end of a DA who needs another scalp.

I don't chill with felons unless they're in the back of my black & white. That broad spells TROUBLE! To parody the Godfather: "leave the dame, take the guns".

This is interesting: "...the police show up and enter the house (they've done this several times in response to THEM calling)." Why did a call originate from their house -- the house where two 'lovebirds' live, one of whom has a history of men issues? They're domestic calls. I'm guessing it's not all walks in the rain, so maybe there's hope for him.

In his autobiography "Will" G. Gordon Liddy (remaining a convicted felon for his involvement in the Watergate burglary) wrote that his wife maintained a good collection of firearms, some of which she chose to keep on his side of the bed. Amusing anecdote at best. I'm sure that any number of prosecutors would love to take another shot at Mr. Liddy.

A really simple solution might be a biometric gun safe programmed to be accessible only to the lawful owner of the firearm and mounted securely to a floor, wall, etc, in the home. It would be extremely difficult for a prosecutor to prove constructive possession by the woman in question.

With so much public fuss about gun control, and so many political irons in the fire (yes, in California also), it would not surprise me if authorities tried to make a case in a situation like this. I would make every possible effort to clearly demonstrate that not only was there no reasonable access to firearms, but that there was a clearly understood agreement denying her any access whatsoever. Perhaps a written agreement signed by both parties, witnessed, notarized.
 
He needs to get rid of the girlfriend and keep his guns.
Guns are expensive girls are a dime a dozen.
Ditch her now while its still cheap cuz it can get expensive if you let um get latched on too good.
 
Like others said, girl friend needs to go. If he won't do that, go talk to a Ca. lawyer. Free legal advice is worth exactly what you pay for it.

I think he should definitely get a gun for her. Maybe he could get a nice .22 auto, maybe a .380 in trade, though I don't think she is worth much more than that. That and the fact nobody probably wants her.

You better bet. I don't know what judges are like in CA but here in IN you generally can expect one warning from a judge - if you're lucky. The next time you hear from him it could be ugly. You shouldn't need a lawyer to explain that.
