My rant re: selling a gun

Why would a FFL Dealer do a 4473 when they are not the seller?

Here in Maryland, all private party sales of handguns are subject to our 7-day waiting period and Maryland State Police background check. You don't have to transfer through an FFL (you can do it at your local MSP barrack) but I think a lot of people find it expedient to do so.

Long gun sales person-to-person are still legal, so long as the long gun in question isn't a banned "assault weapon".
 
Oh yes. I've seen people on this and many other boards state that they would happily sell face to face. Just show them a copy of your driver's license and your carry permit.


Why the carry permit? There's several million people in the state of Florida, and maybe 10% of them have a permit to carry. So you're blocking out 90% of your customer base. It makes no sense.

Maybe so, but at least when you do that you know the person has been through some kind of background check in fairly recent times.

With the amount of time Nevada allows our DPS to check on us after submitting the application (120 days IIRC) we should be cleared for nuclear launch codes.:rolleyes:
 
I have no time or tolerance for foolishness. Causing unnecessary hardship to complete a transaction because one can is repulsive. Why not just place them all on consignment (as was previously suggested) and remove the unpleasantness from the process?

Here is an add from a local forum. Why anyone would bother to jump through hoops to deal with this person is beyond me.

First off, it sounds like this person might be what the ATF considers to be an unlicensed dealer, since he says he has more than one for sale. Secondly, the whole meeting location sounds suspicious...and the "take it or leave it" attitude is a real turn-off.

In today's litigious society, and with all the stories about mass shooters going out and buying their weapons right before they use them to commit crimes, I can't blame anybody for being cautious and covering his derriere by asking for ID or insisting on a background check. There is, however, a way to go about that without alienating and turning off potential buyers.
 
In Ohio resident to resident sales are legal. I have only sold 2 guns in the last 30 years, and both instances the sales were to longtime friends with the agreement that if they decide to sell the gun it goes back to me for the original price they paid unless there are condition issues that would warrant a reduction in price.

I would be nervous selling to someone I do not know well considering the times we are living in. So, I can understand how folks are trying to set the sale terms transparently up front and I don't blame them, however I would pass these listings even if it was a gun, I really wanted just because of turn off factor.
 
I'm legal to purchase and could meet all those requirements. But no way would I engage that seller. Definitely too much a hassle. Want to sell ads should be pretty concise.

when a school age boy agrees to mow your lawn at a certain price should he ask to review your home owners policy to review your liability limits ? who will be paying his workmens comp and unemployment ?? just asking i know you want to do whats right ,
 
You can’t really tell by looking who is a prohibited person or not. If you want to sleep at night knowing the buyer is legal to own guns, there are ways to be 99.9% sure. Your choice.
 
I believe here in PA handguns are to be transferred at an FFL. Not sure about long guns. If the buyer of my gun uses it in a crime and the law finds it, the serial number would lead them to the buyer, not me, hopefully. Living in this city for the past 25 years I've become friends with some people that I may need a favor from some day, and I don't want anything to get in the way.
 
there used to be a lot of crime in u s , thanks to the laws passed since 1968 weve got it under control now, a legal sale is a legal sale.
 
It is your gun and you can sell it however you want. But, I would probably wouldn't even finish reading the ad unless the guns description was forefront and it was something I really wanted that was hard to find.

Why bother. First of all in a state where private sales are legal, he shows the cash and a state ID and he gets the gun. Your liability once the transfer is made is no more than it is through an FFL. Zip Zero. Would you only sell your car through a dealer? What if the guy pays you, drives to the bar and gets hammer and has a wreck. I don't do business with people that complicate simple things for no reason.

But, putting any kind of ad in the paper or on the net will get you some odd ball calls no mater what you put down. People never think you mean them. My advice is to simply ignore them, stay at peace and go on about your business.

Long guns can be face to face.

There are exceptions to the handgun rules. Spouse/spouse. Parent/child. Grandparent/grandchild.

I don't have an objection to the check, I don't like the added expense. Some shops around here charge $40 for a transfer.

From the ATF website:

“…the GCA at 18 U.S.C. § 922(d) makes it unlawful to sell or otherwise dispose of firearms or ammunition to any person who is prohibited from shipping, transporting, receiving, or possessing firearms or ammunition.“

Is "knowingly" included in the verbiage of the code? One thing I've noticed with alarm is that when stuff goes wrong a lot of America assumes that you should have known or (worse) you must have known.
