Local Shoplifter Shot

Need more details. At the door did the shoplifter say anything? if not, he'll need a good attorney to explain how scared he was. I guess :confused:

"Midland Police reported responding at approximately 3:35 p.m. Friday, Nov. 8, to a shooting outside of Mr. Puff's Smoke Shop in the 4300 block of Andrews Highway. Additionally, MPD reported that witnesses on the scene described how a male was inside the store asking about items to purchase costing approximately $130.

“The items were placed on the counter near the cash register,” MPD said in press release from the city. “The male then grabbed the items without paying and went towards the front door of the store.”

Joshua Miller, 27, said to be a store employee, walked from behind the counter toward the front door following the male, MPD said.

“The store employee fired one shot striking the male in the back, causing the male to fall to the ground outside of the store,” MPD said. “There were no reports of the victim making any threats or producing any type of weapon during this incident. The victim was subsequently identified as Deandre Jefferson.”

The proper response by the employee should've been....

"Hey, you forgot your change." or "Do you need a bag?"

If the thief turns around then that is when you shoot him.

"Your wallets on the counter" should get them to stop where they can see the gun and be given the opportunity to drop the goods.
 
Shoot someone over "stuff" that probably didn't even belong to him?

Not justifying it, but it’s legal in Texas to use deadly force to protect property.

He’s going to need a good lawyer but he should get out of it.

I think he's screwed, as he should be. I was curious about that law, so I looked it up. It only applies to theft at night, this happened at 3:35 in the afternoon. Conditional on no other way of recovering the property...good luck proving a bullet in the back was the only way to guarantee recovery of the property. And if this is just a store employee as the news reports, does the law even apply to him since it wasn't even his property to protect and recover?
 
Killing/executing someone over stuff doesn't sit well with me, life is not a video game.
Locally a citizen was home and heard his vehicle start up outside in his driveway. He was a more alert individual and grabbed a conveniently placed handgun and went outside to see what was going on. Someone was behind the wheel of the vehicle, he showed that individual he was armed. The guy put the vehicle in reverse and proceeded to back down the driveway. Our hero yelled "Stop or I'll fire." The guy in the car, went to drive and attempted to speed away while probably flipping our hero off out the back window. Our hero fired one shot, one shot that changed his life forever. He was not extremely well trained but that one shot caught the perp in the back of the skull and ended him instantly, the vehicle went aways and crashed into a parked car. Our hero was arrested, had his day in court where he was acquitted although in the process lost his job that he could not attend while incarcerated, lost his house and if I remember correctly lost his wife who could not get behind killing someone over a car. Some people are not thinking about the outcome when they react or overreact to a situation.
My quick tempered, well armed son was in my house three years ago. We were talking in the living room when I see him draw his concealed firearm and say "Dad, there is someone in your backyard." I said "Put that *******ed thing away, that's my lawn care guy spraying my lawn." I told him that if he ever pulled a firearm in my house again that will be the last time you'll be welcomed.
 
I still think the only hope the guy has is to have an attorney who can convince people he was scared to death and was shocked the gun went off because he can't remember pulling the trigger.
 
No matter how much the thief may have deserved it, shooting an unarmed, non-threatening individual, especially in the back, is never a great idea.
I agree completely but I also wish the bad guys could understand that bad things may happen when one skates away with the day's profit and they really have no one to blame but themselves.
