Default No sale of Sharpies to anyone under 18

My wife asked me to stop by Walmart while I was in town this afternoon and pick up a package of Sharpies, the felt tip markers. I went to self-checkout but when I scanned the barcode the screen said I needed an attendant to approve the item.

The young attendant who came over had to verify that I was over 18. I asked why. She replied that it is illegal to sell sharpies to anyone under the age of 18 in Texas. Again I asked why? She replied, “I don’t know, I didn’t make the law.”

HOLY COW!!! It’s a package of Sharpies not a box of ammo.

I thought about this on the way home. Like cigarettes, if I buy a Sharpie for a minor, am I in legal trouble?

Are they sniffing them or something to get high? Or writing stuff on bathroom walls, angering janitors?

Had the same thing at other stores for cans of compressed air for blowing off computer keyboards, or gun parts.

In the society we now have; you know the one; (where every one is held blameless for their stupid actions), I sense a magic-marker lawsuit juussst around the corner.

Wonder what the clowns who wrote this law were smoking when they thought this idiocy up.

Don't forget, when sharpies are outlawed only outlaws will have sharpies.

Grafiti is the main reason I suppose. that said, Sharpie's are everywhere! I've got them in my office, Workshop, Garage, Kitchen, Car, and probably some in other rooms I forgot about. Anyone who wants one will easily get one. I know the kids are more than smart enough to order them online - and save money to boot! Feel good - - do nothing law! What else is new?!!

I can't mark my targets without a sharpie. I wonder if that is the real reason?

I carry a sharpie in my pocket all the time, buck brand with a 4 inch blade. Use a case brand sharpie to gut a deer if I get one. Had a boy scout sharpie when in scouts. Maybe this was what she thought she was checking? nah, that would take reasoning power.

It's not just Texas. Numerous states and municipalities have anti-graffiti permanent marker laws.

Our lawmakers have been adding laws to the books for 241 years. They've already written laws to cover all the obvious stuff, then they covered the stuff that made a little sense sometimes, and they were wondering what else they can write laws about. They each hold pens everyday, and the light went off in one of their heads ... It was a no brainer.

Just think of all the children who are being "saved" from a life of crime by prohibiting them from buying Sharpies! I'm sure we will soon see headlines stating that "Sharpies Used in Mugging." Bad words were written on the forehead of a person.

Default SHARPIES

Kids now-a-days don't know what they're missing Heck, back in the early 60's ( my Jr.High days), rolling a box of those little Jaw Breaker candies down the aisle at the movie theater was great fun They must have been outlawed( they have become a vile corruption of our youth). Don't even see them in the candy section anymore. Sharpies will be next

Weird indeed as I purchased a large package of these sharpies for the office at SAMS club yesterday.

Never saw any age verification or attendant required when I checked out.

Yes I used the self check line at SAMS.

FYI never heard of this "law" as most school supply lists require you send kids with them to class on day one.

The just call um "markers" on the local school list.

Bought a $4.00 knife at Wally World, the self checkout flag popped up. The nice Lady came over and confirmed that I was over 70.

There's a lot of odd laws.

1. It's actually illegal to sing "Happy Birthday" in a public place because the song is copyrighted.

2. According to the United States computer fraud and Abuse act it's illegal to use a fake name on the internet.

3. Anti graffiti law makes possessing a sharpie completely illegal in Florida, California, New York and other states

4. Swearing in public

5. Opening a Christmas present early in S. Carolina without your parents’ permission can actually get you booked on petty larceny charges.

6. Cafeteria food fight can get you reckless conduct charge

7. In Orem Utah it's a crime NOT TO water your lawn. Brown grass is a crime

There are many more even stranger laws

Arik, number 1 is no longer the case. [Yah!] Federal court has ruled it is in the public domain in the US.

Maybe they will pass a law to issue serial numbers and register them too. They'll have to be locked up while unattended.

The Constitution and Bill of Rights gave us certain inalienable rights and the politicians been taking them away ever since.

I just bought a pack of sharpies for use at work a few days ago. Nothing said to me. Also, ive sold many packs of them, ive said nothing because ive not been informed of any such and stupid law. Stupid laws--at least some of them--when ignored (like the infamous blue law from the 70s) go away. This likely will as well.

Also--there OUGHT to be a law passed that for every new law--there ought to be at least three old laws stricken from the books.

IF, there is a law on not selling these pens to those under 18? it's unenforceable.

I was helping my kid sand and repaint his truck bumper. We ran out of paint, so I sent him to the store for another can. He had to get the guy behind him in line to buy it. I trust him more with a can of paint than driving a vehicle.

This is probably one of those cases where the employee didn't have a freaking clue what the answer was, and made it up. The store might have a policy, but apparently no such law exists.

Is it true that using permanent marker under 18 years is illegal in the USA? - Quora

They should just do back ground checks and register them. Then each should have a taggant in the ink. Then, whenever they were used illegally the law could easily determine who the criminal was. The purchaser should also have to install a bio-metric safety so that only they could use it.

It would all be so easy. America could have safer walls. But a big part of it is America having such a horrible Sharpie culture. Suspending that horrible freedom of speech and press amendment is necessary for the children! Where is the sanity I ask?

It's a great proxy for why some gun control laws don't work so well either on several levels. If you are a minor who wants to write graffiti and you cannot buy a marker at the local wal-mart you will:

1) buy one illegally on the street;
2) ask your just-turned-18-yesterday graffiti buddy to buy one for you;
3) steal one from a local marker shop;
4) steal one from a law abiding marker owner;
5) just use a crayon instead; or
6) go big and just use paint.

Restricting the sale of markers will create a whole new class of crimes and criminal endeavors, make it harder for a kid with a legitimate need to get a marker (I wonder if highlighters are considered to be markers?) and will do absolutely nothing to solve the underlying problem.

Markers don't make graffiti, delinquents do....

Huffers do sniff Sharpie ink to get high. The ink contains alcohol and ethylene glycol monobutyl ether.

Now, I have no idea how much Sharpie ink would need to be sniffed, or how many Sharpies would be needed.

Fact: People looking for a high will try anything.

I don't know of a Texas law about minimum ages of anyone purchasing Sharpies, but some municipalities may have restrictions. Or maybe even retailers. I have bought a lot of sharpies, never have been asked any questions about my age.

I do not know how to check the State regs for such a law, but I did find a Houston ordinance to that effect. It states broad tip, the Sharpies I bought Saturday at the Kroger self-checkout were fine point, and I was not screened for purchase eligibility in any way.

The buzz is very short lived so the user employs 'rinse and repeat'. . It also causes discoloration of the nostrils.

It's illegal in California to have a sharpie that doesn't imprint it's serial number in the line it's drawing. It's called micro imprinting.

The worlds turned upside down. Blunts are legal, sharpies are illegal.
Soon the Zeta and Gulf Cartel will be battling over the importation corridor.

Law was passed by a cadre of Texas of country music enthusiasts who do not like Simon and Garfunkel

The compressed air at WalMart wasn't locked away but I did have to get "age verified" to buy it the other day. Compressed Air! Morons.
