The correct term is “delayed”. Not pending. You can be delayed because you have a common name. In that case you need a UPI number. Your gun shop can help with that.

You can also be delayed because the NICS call center is busy.

Federal law states that you must complete a 4473 and background check for each gun purchase. Complaining won’t help.

No, the term is "pending "

I'm in PA, and they do not use NICS here. It is PICS, run by civilian employees of the PA State Police. And that's what comes up in the status screen.

It's not normal.

Nor acceptable.
 
When I lived in NC, all that was required was filling out the 4473 form and showing my NC Concealed Carry Permit and I was out the door with my new purchase.

Great information, except for the fact that he’s in PA and they do not use NICS but a state run system called PICS.
 
I usually have a 1 hour wait time. I think it's because of an arrest that I was not convicted of, but I think it makes the 0s and 1s in the computer system trip over themselves. I would think if you have a concealed carry permit that should be good enough. Heck, I worked for the Board of Education and all 3 checks came back clear.
I do think we have better gun laws than many states. Heck, if I'm driving anywhere near New York I search every nook & cranny of my car to make sure there isn't even an empty shell casing!
 
With a Nevada CCW, there is literally no delay in purchasing a firearm here from a LGS. On private sales, both parties must visit a LGS to have background checks performed. When our 'beloved' governor was asked if CCW holders would require the check since they had already been thoroughly vetted, he naturally replied they would have to submit to the check also...

At an LGS/range I go to in Eastern PA they got a hit on a would be purchaser-outstanding warrant, which turned out to be in error. Harrisburg asked them to "detain" the individual-"the line is busy"-while they contacted the local PD.The whole thing only took about 30 minutes.

I had one similar when I owned my gun store...A moron filled out the 4473 for a Glock, and got a delay...I got an almost instant call from the US Marshal Service who asked me to delay him until they got there...I told the subject the delay shouldn't take long, and not to wander off...In the meantime I called the Sheriff who quietly dispatched some plain clothes detectives in the store in case he bolted...The closest federal marshals were in Beaumont who drove to Conroe with lights lit up all the way...When they walked in I called the subject to the counter and told him he could have his gun just as soon as the fellows behind him approved his purchase...As they were handcuffing him he peed his pants, which I had to mop up later...

He was wanted on several outstanding federal drug warrants...As they led him out the door he tried to run with hands cuffed behind him...He did a face plant on my parking lot, and cooperated after that...I later refunded his money to his Mom who also had to pay the impound lot for his Jeep which I had towed away...

It takes me about 30 minutes. I show him my DL and CWP and I check my new gun out while he writes, then I fill out the 4473 while he looks at the gun. He hands me the gun and we shoot the breeze for 20 minutes before I leave with the gun. No call. Unfortunately he is selling his place of business and rather than setting up a shop for his FFL he is quitting. But, then we can go out shooting prairie dogs more often

Oregon is presently taking right around 3 weeks for the "instant" BGC. A friend went to pick one up on sunday during the Memorial holiday weekend. After 2-3 hours of BS'ing with our friend/FFL holder, he checked to see the progress. Had not moved a single position---still number 3664. Guess they must take the holiday weekend off. FFL is guessing 3 weeks plus. As long as we are ranting---Oregon also charges us $10 for the "instant" BGC.

Most bad guys don't buy their guns at LGS.

I'm a law abiding gun owner.

I'm sick of this happening EVERY TIME.

Even pre-pandemic I'd go into pending, or if called in I would always be sent to an operator.

It pisses me off even more when I'm trading a gun for another. That should be a wash AFAIK.

Never had that problem here in Florida until a year or so ago. They were back logged and it took me a hour wait at least two times. Things are starting to get back to normal here I guess as I picked one up today and the BG check only took a couple of minutes to come back.
 
Delayed

In the resent years I was delayed every time even though I have a state issued CWP. My local gun store talked me into getting the personal pin number from the Feds and it works every time.
And a note of humor, an OKC Female Police Officer in uniform was delayed at a time I was in the store. Her actions and language were quite humorous!

According to my LGS, there is no provision on the PICS website to enter the personal PIN number. Because I asked about it after getting fed up with this bovine excrement. It's on the 4473 but not on the PA State Police "white paper" required for a handgun purchase. That in and of itself is a subject for another rant, but not tonight.

Like the PA State Store system, the PA Turnpike Commission, the PICS is antiquated, and probably full of patronage and nepotism like the aforementioned PA agencies.

Love my State, hate my government.
 
Here in Arizona, it's simple. If you have a concealed carry permit, you are vetted and considered good to go with your new gun. No wait, no mess, no fuss.

Same with Louisiana . No check . Fill out the 4473 , pay the man , go .
 
Here in NJ "they" decided the State Police will perform the background checks. So you pay your money, fill out the 4473 and a state form testifying to your eligibility-and they text you when your background check is completed.

Your issue is entirely with the state of PA.. Remember that next election. Is there a state gun owners organization? If so, do they lobby the state legislature about stuff like this? Here in Iowa, the Iowa Firearms Coalition has great success doing that to improve the state firearms laws.
