Someone was huffing paint with the Good Idea Fairy and put that forward without running it past their civil counsel. Once in a while that happens in a place with which I am very familiar. A couple of us give feedback using language that would cause the moderators to have strokes, and then there is some rapid backtracking.
 
It sounds like the "California Insanity Pandemic" has taken hold in your area and has been imported by all the people moving from Calif.

The order authorizing the suspending of sale/distribution/transport of firearms also applies to liquor, explosives, combustibles, etc., and is entirely separate from the section about entering private property. Both are also entirely standard emergency statute provisions, much as we like to freak out about stuff. ****, even Florida has the firearms language in their emergency powers statute (Statutes & Constitution

Saguache County viewed and adopted some standard emergency authorities language, some citizens got mad about it, and the county said oh yeah I guess that's not the best, lets change it. The system worked, but lets still be mad about it.

Our county council used to pass those types of ordnances (private property entry) that were a clear violation of state and federal law. After a review by the prosecutor's office they were rescinded. I had to point one out one time when my supervisor wanted me to trespass on private property on "official" county business. He wasn't real happy when I got a legal opinion from a county attorney but homie don't play those games.

Montana law specifically prohibits confiscation of firearms during an emergency.

Confiscation Of Firearm And Certain Actions By Government Prohibited -- Private Right Of Action -- Costs And Expenses

10-3-114. Confiscation of firearm and certain actions by government prohibited -- private right of action -- costs and expenses. (1) Following a declaration of an emergency or disaster pursuant to this chapter, a peace officer or other person acting or purporting to act on behalf of the state or a political subdivision of the state may not take a confiscation action or:

(e) unless the closing or limitation of hours applies equally to all forms of commerce within the jurisdiction, close or limit the operating hours of any entity engaged in the lawful selling or servicing of any:

(ii) ammunition, including any component or accessory;
(iii) ammunition-reloading equipment and supplies; or

Plus the law allows anyone who was subject to confiscation redress

(2) After a violation of this section has occurred, the party injured by a confiscation action or other action prohibited in subsection (1) may bring an action for damages in a court having jurisdiction.

(3) A party awarded damages pursuant to this section must also be awarded the party's costs and expenses in bringing the action, including reasonable attorney fees.

(4) (a) As used in this section, "confiscation action" means the intentional deprivation by a person in Montana of a privately owned firearm.
