Fed Judge Rules On Machine Gun Ban

The NFA and it's corresponding tax on certain firearms has always been unconstitutional, as is the 1986 FOPA ban on 'new' full auto firearms.

Fortunately, SCOTUS gave us Bruen, and overturned chevron deference, so the whole house of cards is starting to fall apart.

Unfortunately, we're going to have to wait for these cases to get back to SCOTUS, and hope they accept the cases and rule favorably before these unconstitutional laws will finally be eradicated.

Two Federal courts have now ruled against the full auto ban, so things are gaining momentum...
 
The prosecution made a mess of the case and the judge reacted.

Wait for it.... to be overturned.
 
If it sticks...it will have a double-edged sword effect. It will allow new select-fire models to be marketed to the general public and prices should come down...how much is difficult to say but the free market will have the last word.

The other side of the coin is collectors who have big bucks invested in select-fire weapons may see some of that value evaporate. Again...how much is debatable. Blue-chip guns like Thompsons will likely continue to hold value but new production could moderate those values some for those who simply want shooters.

The usual suspects will start crying and whining in three...two...one...

I do not consider myself to be usual nor do I cry and whine.

I disagree that only some of the "value" will go away once the 1986 legislation is overturned. Most of the price(value) will go away on all select fire Title II firearms.

Remember that is not true value. It is fake value imposed upon us by limiting the existing supply

As an owner of many select fire, Title II firearms(some favorites pictured above), I will be ecstatic to lose money on the ones that I own, so that I can gain the ability to buy anything I want.

There will always be those who cannot stomach any loss in "value", regardless of how false that value might be. They'll do almost anything not to take what they see as a financial hit. I've seen it in the milsurp collector community. Indeed, one joker on a French weapons board crowed that if he saw something going cheap on an auction site he would run it up until it was at least at the number he paid.

The fact that you only "lose" when you sell is beyond some people.
 
Being able to buy a couple Flemming auto sears for my SP5 and SP5K, plus converting a few AR's to select fire would be most nice. I can't see it happening thou.

I'd be happy if they just took silencers off the NFA list. Probably a better chance of that happening.

If the legislation is rolled back, there will be no need for an aftermarket "Auto Sear"

The G3k pictured in my first post is a registered receiver, any lower (fire control group) that HK makes just gets pinned on. No time consuming moving of the sear from trigger group to trigger group.

The same goes for my 9MM MP5.

The 10MM Auto and 357SIG MP5s did not exist prior to the Firearm Owners' Protection Act (FOPA) of 1986 so they need to be sear guns

IF anything happens, it will be in little baby steps, not all at once

Passing of the recently reintroduced (119th Congress ) Hearing Protection Act (H.R. 404/S. 364) would be a nice start

I agree i'd more like to see suppressors de-regulated, but what would make me even happier would be to have the hearing in my left ear back, lol.
 
Easy legal trade in full-auto firearms would certainly bring down the price of meat for cartels in Mexico and street drug retail organizations here.

Going too far is one path to ensuring antis have enough public and political support to amend the Second, and not to our liking, IMO.
 
I want one of those MP5 machine pistols that fits inside the special brief case……..

Back in the 70’s friend had all the MAC sub guns and the 380 in the briefcase. We used to shoot it at the indoor range I managed. I prefer the Swed K….

the Swedish K is a dream item..
if the Hughes amendment gets reversed somehow I hope S&W resumes manufacture of the Model 76.. I will NEED one of those somehow.. lol
