FFL question on ATF Form 3310.4 (multiple handgun sales)

Ok, it's actually called Report of Multiple Sale or Other Disposition of Pistols and Revolvers.

If I understand it correctly, if I bought a handgun from a FFL last Saturday (open Mon-Sat) and I buy another one this Thursday that they would NOT be required to complete and send the form to the ATF and the locals.

I'm a law abiding person but also firmly believe in the government having less papers with my name on it. Not just the feds, but the dealer I buy from is in Dallas so I'm not sure if it does to DPD (eh') or Dallas County (train wreck of a "sheriff").

You have the Sunday in between. That should answer the question.

I believe you are mis-reading the term.

Store is open Saturday but not Sunday? He bought one Saturday.

Saturday, Monday, Tuesday, Wednesday, Thursday. That's "five consecutive business days".

So yeah, if he bought one Thursday, it would fall under.

You could pay for it Thursday, and tell him you'll be in to do the paperwork Tuesday. That would make it the sixth business day.

I've done that before, a couple of times. Paid for a pair of single actions, but only took one home. Came back a week later and did the 4473 and call-in on the other one. Don't matter when the money changes hands. Gun ain't sold until the paperwork is done.

Put it on layaway for a couple days. If you bought from him before I don't see why he wouldn't do it. Or pay in full and fill the paper work when you go to pick it up.
 
Didn't really want to wait, but I might.

I did it two years ago when I was able to snag a 37 for $175 and a 19-? for $225. Took the 19 home that day and the 37 a week later.

Still have the 37 in my pocket every day.
 
The law states "5 consecutive business days" an as I have been in the business for a while I can state it qualifies as a "PITA". If you don't want to be on the list of possible gun-runners(and want to save your dealer from extra paperwork!) just spread your purchases out another day or two. Layaway is your friend! A small deposit and pick the second one up later
 
Is Saturday considered a "business day"?

That's why I say wait seven days.

They don't do lay-a-way but I'll probably pay for it Thursday and go back Tuesday to do the paperwork. In all honestly, I'll have a lot more time Tuesday anyway.
 
Gang, those 5 business days are government business days not the LGS business days. Saturday and Sunday are not government business days. That's why most shops say wait 7 days. It's still a PITA. Yes one copy to ATF and one to your local county PD who ever they are.

The place I worked had a customer who was rebuilding his Smith collection a few years ago and got many of those forms sent in. He got a personal visit from ATF after a couple years. By that time he had 5 safes as I recall and spent some time in a enjoyable conversation with 2 agents.

I think.......If you buy one on Saturday, you would have to wait till Friday to not have the form utilized.


I believe business days would be the gun store business days, not gomment, the bank, barber shop's etc.
 
My FFL thinks that it is 30 calendar days. I need to educate him! He told me that if you went to different FFLs that the ATF would never put it together. Of course he may be wrong about that as well.
 
I take 'em two-three at a time & have my guy fill out the form. For the most part they're all C&R wheelguns of .22 or obsolete calibre.

As hard as ammo is to find I would be closer to being guilty of potential gun clubbing if I was selling any of them.
 
I carry multiple purchases out of the LGS on the same day, by the box full. When I get home, I pull the box out of my SUV and hold it up to the sky, in plain view of the satellite ATF parked over my house.

I like to point mine butt to the sky, so they can read the SN.

I'm happy you guys don't mind the extra scrutiny from our benevolent .gov and that's great!

But there are others, myself included, who don't want anymore attention than what we already get when making a firearm purchase - especially those of us who live border states and are subject to even MORE scrutiny.
