Florida Sheriff overstepping his bounds

I would be interested to know how many private sales are conducted during the weekend. The last figure the talking heads had it at 60%.

If criminals can read they can always get their guns through FTF meetings arranged from the internet, assuming they have a valid state license. Yes this law will eliminate all future crime. :) Private sellers could offer a deal more in line with the market if they saved the cost of a table and all that wasted time downtown. Gunshows are just museums for the most part.

Personally I wont sell to anyone without a drivers permit, a voter registartion card or a CCW permit, just me. If they aren't a law abiding type I don't care to deal with them.I agree with 99.999% of other gun owners, crooks shouldn't have access to firearms.

.

Let's jest wait and see how this sets with his constituents....

I'd say he'll have to adjust his sails to the political winds that blow in from this lit'l deal.

Story Time,

When I first started working this one particular county, I approached the local Sheriff about assisting in a round-up of a cockfighting ring.

The good Sheriff said, "You can go out there and stick your chest out if you want to,
but don't look for me or my deputies to assist you when ya get yur tit caught in the ringer.
There's a lot of votes in that neck of the woods!"

So, sometimes a feller got to use a little discretion......I reckon.

Of the last 7 guns I purchased, 6 went through the background check. If this is as strict as the gun laws are going to get I can live with it.

FTF SALES IN FL

I bought 13 this year in FL, only 2 went thru a ffl. sold 4 ftf. I follow the law but a FL drivers license doesn't tell me anything. a ccl is a +, but that could have been suspended/revoked. none of the buyers/sellers I know would knowingly sell to a criminal. instead of a list of good guys, wouldn't it be simpler/easier/ and make more sense to have a list of bad guys that us private sellers could actually use quickly and free?

90% of my transactions are f/f. I require a GA DL because that tells me that, most likely, the buyer is indeed a GA resident. I always show my GA DL and GA Weapons Permit without being asked. Nine times out of 10, the buyer/seller shows his permit if he has one. I would guess that half the transactions I have done f/f over the last few years have been with LEOs of some description, ranging from County Deputies, City PD, and at least one State Revenue Agent. I asked the Revenuer if he wanted to see ID. "Naw," he said. "You look honest."

I have done very little buying/selling at gun shows, although there have been a few transactions there.

GA also has a State Preemption.

Why are they not simply updating the drivers license with more information? They could mark that you are a US citizen for making sure only US citizens vote and if you are a fellon that you are not allowed to buy a gun privately. So in case you would encounter a guy who wants to buy a gun, you simply ask for his drivers license. Just mark the crooks, very easy.

All anyone there has to do is this:
790.33 State preemption-
(3) PROHIBITIONS; PENALTIES.—
(a) Any person, county, agency, municipality, district, or other entity that violates the Legislature's occupation of the whole field of regulation of firearms and ammunition, as declared in subsection (1), by enacting or causing to be enforced any local ordinance or administrative rule or regulation impinging upon such exclusive occupation of the field shall be liable as set forth herein.
(b) If any county, city, town, or other local government violates this section, the court shall declare the improper ordinance, regulation, or rule invalid and issue a permanent injunction against the local government prohibiting it from enforcing such ordinance, regulation, or rule. It is no defense that in enacting the ordinance, regulation, or rule the local government was acting in good faith or upon advice of counsel.
(c) If the court determines that a violation was knowing and willful, the court shall assess a civil fine of up to $5,000 against the elected or appointed local government official or officials or administrative agency head under whose jurisdiction the violation occurred.

Take the good sheriff to court. He does not establish the requirements for firearm purchase. That's up to the Feds and state.

The Sherrif can be sued personally for deprivation of rights under color of law USC 42 ,1983,tort litagation is nesessary take his time, house, car and he will get the picture find a lawyer who isnt a coward, or become a pro se litagant and if you have standing sue!
