Houston Taqueria Customer Kills Robber

Completely justified.......but a little over the top. First few shots.....great. But at some point, it turns into an execution.
 
What are they going to say? He should have thrown a bowl of diablo salsa at him?

Probably that he shouldn't have stood over a motionless person and put an anchor shot into him. That's a good start
 
The problem the prosecutor will have is proving that the deceased was still alive when the last shots were fired.
And Texas has some really unusual legal precedents down there.
 
Dude was probably dead when he expended the last shot or two, so what is the penalty for shooting a dead body.
 
I see a guy jump up from his booth after the threat passed him and shoot the guy in the back as he's headed for the door. I think the shooter is screwed.

Heading towards the door, but not out of it. I don't know that I wouldve drawn, but (without the benefit of hindsight telling us that it was a fake gun and he could not have shot anyone) the shooter was in a confined space with someone he believed had a gun and had already demonstrated his willingness to the threaten the lives of others. He doesn't know if the guy is going to turn and fire, lock the door and get up to worse crimes with him and the other customers, whatever. Zero problem with the guy drawing and shooting the robber who still posed a real threat to him inside a confined space as soon as he had the upper hand. Just, yaknow, the rest of it is pretty bad.

Are you or anyone sure he was headed out the door? Was he headed toward the guy sitting by the door? Did he still have a gun in his hand, threatening everyone in the diner? Are you absolutely convinced he might not have turned around and pointed the gun at anyone else?

Perhaps you should review the laws on use of deadly force for Texas before assuming the shooter is screwed. The only thing I question is the coup de gras shots after the robber was down.
 
Shooting a dead guy may or may not be a crime, but it's not a really deft public relations maneuver. It will be interesting to hear the public servant explain his reasoning, if he had any and chooses to share it.
 
Two camps have arisen on the web; one in support of the CC holder and one that would see him pilloried.


The CC holder made his choices and will now have to deal with them.
