Just cleared a burglary and I am super annoyed!

Ok - most of you know I work the pawn shop detail for my agency. I just cleared a burglary case last week and I must admit I am really pissed.

Here is how it goes.

In the last week of May I am notified that Playtation pawned by a lady, is reported stolen by our agency. The Playstation was reported stolen in a burglary at the end of 2008. The case is assigned to one of the investigators, who gives me the OK to follow through with this as far as I can develop the case. I place a hold on the Playstation and begin the investigation.

So I contact my victim, through a cell phone and leave a message. After several days she finally gets back with me, and tells me she does not know the person that has pawned the Playstation. I begin the follow up investigation.

The lady that pawned the Playstation has three or four addresses in our system and none of them are any good, I know, because I went to all of them to locate her and she was not at any of them. Finally, locate a good address outside of our city and send her field status card requesting she make contact with me.

Several days later she leaves me a telephone number for me to call on my answering machine. I call, make contact. I ask her about the Playstation she pawned. She tells me that it is her son's and she will pick it up next week.

I tell her - - "No you won't, this Playstation is reported stolen", and I need to know where and who you got it from.

She tells me it was given to her son by her ex-husband for the child's birthday.

So I ask her for her ex-husbands contact information, which she gives me.

He is a truck driver so he is on the road a lot. More days pass. Finally make contact with him, and ask him where he got the Playstation from.

Now my truck driver friend (?) is not interested (at first) in telling me where he got it from. He is interested if his ex-wife is in trouble for pawning a stolen Playstation and is he going to get it back? After several phone calls and visits I finally convince him:

A. His ex will not be charged - he is not pleased with this.

B. He will not be charged (if he tells me where he got it from) - he is pleased with this.

C. The Playstation is stolen, he nor his son will not get the Playstation back - he is not pleased again.

He tells me he bought the Playstation from a resale shop in my city.

I make contact with the resale shop, that fortunately keeps good records and lets me know who sold it to them.

It is significant that the Playstation was sold to the resale shop on the same day it is reported stolen.

I now have the name of the person that sold the Playstation to the resale shop on the day it was stolen, let's call him Billy Bob.

I call my victim (complainant) and ask her if she knows Billy Bob. She assures me she does know Billy Bob. I ask her is Billy Bob had access to the Playstation. She tells me that he did have access. She is happy as this Playstation is a rent to own deal and she is still paying the company so as not to ruin her standing with them.

So I tell her, OK you need to come to the station and give me a statement that Billy Bob never had permission to remove nor sell your Playstation. I will then get an arrest warrant, we will find and put Billy Bob in jail, and I will then seize your Playstation.

There is a very long pause on the telephone - - - - - "You mean he is going to jail?"

I always hate this part of the investigation. - - - "Yes, my job is to put people in jail that steal from other people - that is what I do, I am very good at my job."

She tells me she will call me back. - - I hate this part, because I know what is coming.

So in half hour she calls back. " I just want to get my Playstation back, but I do not want to file charges."

I am ready - - "OK, if you do not wish to file, then you will need to buy the Playstation back from the pawn shop. Remember my job, I put people in jail that steal from other people, I am not, I repeat NOT, a collection agency." She is not happy with me at this point.

She tells me she will have Billy Bob call you.

A half hour later Billy Bob calls me. "I hear I need to talk to you."

I assure him that indeeed he does. I need to know where he got the Playstation from.

Billy Bob comes later that afternoon. He gives me a written statement and he states that Homer Gene brought him the Playstation to sell at the resale shop because he (Homer Gene) did not have any ID to sell the Playstation.

Without going into the details, Billy Bob's story does not fly. Lot's of holes and things that just do not match up. But I take the statement and act as though he is my very best friend (He ain't).

So I call my victim, leave another message on her cell phone and wait for her to make contact. She finally does and I tell her that she really needs to come visit with me at the station.

When she comes into the office I set down the facts of the case.

1. I know who pawned your Playstation
2. I know where she got it from (her ex husband)
3. I know where he got it from (the resale shop)
4. I know where the resale shop got it from ( Billy Bob)

Now we are gettin down to deception aspects of this offense - Billy Bob says he got it from Homer Gene. I have not been able to locate Homer Gene to get his side of the story but I am just willing to bet that he will have different story from Billy Bob - call me crazy, but I don't think Homer Gene is going to confess on this deal. Remember, Billy Bob did not have a really good story.

So I ask her do you know Homer Gene. She again assures me she does.

I ask her - "Could Homer Gene be capable of stealing from you?" She tells me that he could.

So I give her the bottom line - I need a statement from her that neither Billy Bob nor Homer Gene had permission to remove the Playstation nor sell it at any resale shop. That way if push comes to shove, I will put both Billy Bob and Homer Gene in jail and let the court sort it out.

There is a real long pause - - - - and finally she states, "Can I just buy the Playstation back?"

I am expecting this and tell her "Yes you can, I will write a letter authorizing you to take possession of the Playstation but you are responsible for all charges and interest." I also tell her that she knows her situation better than I do but she is allowing one or possibly both individuals to get away with burglary.

She says she understands but is choosing to pursue this pathway to resolution.

So all my work and effort go into a exceptionally cleared burglary with no charges filed.

I am annoyed.

Billy Bob and Homer Gene need their heads racked together. I'm annoyed with them too. They need to find employment.
 
Pawncop-take a deep breath and chill. I had a day like that in Misdemeanor court-I had three cases where the client just wouldn't plead guilty in spite of overwhelming evidence against them.. In other words they were being stubborn and did not want to be on probation (which would have hapened if they pled) We tried each case and predictably each was found guilty. The judge handed out sentences ranging from 30 to 90 days. There was great wailing and knashing ot teeth :D Justice usually finds a way ;)
 
I had days like that when I was an officer. I always hated those days. Sometimes you just have to look at the bright side of things. You went home today and tomorrow there will be somone else to chase down to put in jail.

Pawncop, rest assured your efforts do not go invane. A year and a half ago my wife and I were victums of a burglary committed by someone we thought was a friend. Long story short local detective located our property in a pawnshop, suspect was arrested, property returned to us, and his case is still pending.

We thank you for your efforts to the people of your community.

As a very experienced once-upon-a-time social worker many decades ago, I would bet there are plenty of OTHER agencies involved with Billie Bob, Homer Gene and the ex as well......
 
Too bad folks can't pawn stupid. It would never be reported stolen, everybody would have plenty of money, and the world would be a nicer place. Joe

I have no idea how long you have been "In harness" but I did it for 21 years until I had to retire for physical reasons. Been through this several times, and usually not because of the victim wouldn't cooperate but because the prosecutor just didn't want to do his job, or the detective that I virtually handed a slam-dunk was too damned lazy to screen it!

Keep it in perspective. YOU did your job, YOU earned your salary fairly, and YOU kept your oath of office by doing so. Just because someone else didn't do their job, or in this case the victim decided she didn't want someone she knows in jail when she found out it wasn't a stranger that ripped he off, you have nothing to be ashamed of.

And so far as being upset/frustrated about wasting time on what turns out to be BS, that's about 90% of police work on the good days! This is even more true today than it was 40 years ago (in 57 days) when I was first hired.
 
Pawncop, hang in there buddy! I really dont know how you guys take the daily aggrevation of your jobs, but you do and you keep doing that job day in and day out. Your job is not thankless, your job is important to all of us out there that you dont get to meet because we keep our noses clean. I worked as a civilian employee for the major law enforcement agency in my state,(retired now!) and made many close friends among the members. I always marveled at how they kept doing thier jobs amoungst all the crap, anguish and anger they encountered daily. Thank you for your service and stay safe!
 
I know it won't help the way your feeling tonight about it, but?
I truly hope it's a cop JUST LIKE YOU working pawn when all of my BIL stolen guns show up. And then another one JUST LIKE YOU works the case of my decked out EBG Win 1300 that was stolen from my BIL after loaning it to him to protect himself with after all of his were lifted. It is noticed and appreciated. And not just by LEO's!

I did our pawn detail for several years and this case of yours is dejavu. The satisfaction I got from this type situation is that the victim is "rewarded" for her failure to prosecute by having to buy her property twice. once for retail and again from the pawnbroker. Some agencies would have screwed the pawnbroker and taken the item away from them. I handled my cases just like you.

Pawncop, I wish it had been you who worked my case about 6 years ago when I had a fortune in family heirloom guns stolen! Will try the short version. Dad in wisconsin died. I hauled many guns to my home in california. My safe was already full and none would fit in. A day or two after I got home with them my truck was stolen out of my driveway. It never has been recovered. (no doubt in mexico). A revolver with custom touchs was hidden in truck. Probley tipped me off as a gun nut. Two days later right after I left house, it was burglared and many guns stolen. A credit card had been in my truck and ran up over 4K. On my own I found a woman who used the card and handed over her forged receipts to sheriffs detective. She had just gotten out of jail on a identical caper. The detective couldnt get her to roll. She just admitted that "someone unknown" had given her a ride in my truck and that she stold the CC then. I think she effectively got several months. I raised hell in court and was given the bums rush. I am not impressed with the sheriff detectives "work" in los angeles county calif.

I'm confused about why you let everyone off the hook? Is it because of the value of the item?

You said you weren't a collection agency, but isn't that the function you filled? You got her to pay the full value of the unit and she got it back.

She STILL owes it back to the rental company and may or may not give it back to them.

She MAY have filed an insurance claim for the original loss and recovered for something she didn't own. Insurance fraud is a crime whether she wants to 'press charges' or not.

Maybe next time, she'll sell the rental company's property again on the black market, instead of using a pawn shop, to raise money to cover what she paid out.


I'm not a cop, but in spite of all your great investigation, it seems that you let a couple of deadbeats off the hook (the mom and Billy Bob...likely her son or boyfriend).

Great job. It has to suck to have all that work in and deal with this B.S.
It also opens my eyes to why the taser was invented. (kidding of course) LOL
 
Pawncop - same story different jurisdictions. Good job, alot more work than alot would have put into it.

Titan - If you have a uncooperative victim/complainant - most DA's won't pursue criminal charges - big waste of the court and their time !! Most of the time, those names go into your mental data base and you deal with them accordingly the next time - luckily, most of us have a memory for dirt chickens and justice eventually gets served!

The thing that bugs me is the "victim" said she knew neither of the perps. But it appears she actually knew both of them. What happened to honesty? I want my stuff back, you do the work but I don't want those misguided kids to get in trouble?!?
 
Pawncop - I fell your pain. It was funny reading your post and remembering the cases I had that were so similar. I had a college kid write $3,000 in checks on a closed account. I spent a week chasing the checks and the kid around until I caught him at my own bank trying to cash one more check as he left town. Prosecutor gave plea deal no jail,probation, parents paid full restitution and he went back to AZ.
