Newbie with a major dilemma!!

OK, I have a major dilemma and am not sure how to proceed. Here is my situation. I have never owned a handgun nor really wanted to. I am a rifle guy and have a few nice shotguns. My 20-year-old daughter came to me one day and said she wanted to learn to shoot a handgun. At this time I did not know you could go to a range and rent one! So I started looking in the local papers and found Turner Sporting goods. They had a Highpoint 9mm for $149, I went down there and was dismayed to find out I needed to take a test, go through a back ground check and so forth, I just wanted to buy a gun so I could take my kid shooting. Anyhow I looked at the gun and not knowing a pony from a stallion "both horses right" I told them I would take it. Then I filled out a bunch of paperwork, paid and left.

Here is where it gets interesting. My 10 day waiting period expires on Friday July2, and I go to pick up the gun. I hand the guy behind the counter my paperwork and he goes into the back room he is there for a while and comes back with a blue case that has the S&W insignia on it. Now I had done a little research on the Highpoint and found it was 100% US made, so I figured that highpoint was just a sub-company of S&W. The guy opens the case shows me a gun and closes it back up. We fill out 5 more pages of paper work, all the time he is taking info from the case and comparing it to the paperwork and when he is done he has me sign and initial all five copies. He takes the gun the paperwork to his supervisor who cross checks all the paperwork and the info on the gun case. Finely after an hour or so we are done and I leave as I have already paid for the Highpoint. I get home and open the case, my wife is nervous, never having a handgun in the house so I case it up and put it away. Yesterday I took the gun to the range to familiarize myself with it. I load the magazines and put 100 rounds through the gun and I did pretty well. I was having a blast so I go buy another 100 rounds and start shooting. In the mean time I see a buddy and he asked me what I am doing there, as I don't have a handgun. I informed him I bought this $149 dollar gun from Turner's and was getting used to it. He comes over to my window at the range and picks up the gun and says it's a nice Sigma, I said what is Sigma the Highpoint model, then he explains to me Sigma is a S&W and has nothing to do with Highpoint!!

Well I put the 100 rounds through the gun, said goodbye to my buddy and went home very much confused. I went over my initial paperwork, which shows I bought a Highpoint; I go over the receipt paper word, which shows they gave me a Sigma!! Upon further inspection I see the name on the case is indeed my last name; however, not my first name!! They gave me someone else's gun!!

Now what do I do? I love the way the Sigma feels, fires ect. And do not want to exchange it for a Highpoint.

If you bought a Hi Point and not a Sigma, then you best be getting back and getting it fixed, if you don't, then someone will eventually come looking for you, probably the sheriffs...

I'm not a Hi Point hater, matter of fact I have a C9 Comp 9mm and the JCP .40 and they are both great shooters, accurate as hell and go bang when I pull the trigger, well worth the money. Not something I would carry everyday.

If you want to upgrade to the Sigma, you are going to have to shell out a couple hundred more clams to the dealer, depending on what they charge. You might get a deal, as the new SD line is coming in and will probably eventually phase out the Sigma, but that is probably still down the road a bit and dealers might still be pricing the Sigmas right up there as usual, and I am not sure if the rebate is still in effect on them either.

Sounds like you might want to do a bit more research, too...
 
I agree.I would take it back before the situation can get ugly. Glad we don't have a 10 day waiting period here in TX.
 
Definately, go back immediately and explain what you've found. As soon as the ATF audits the dealer's paperwork and the problem is discovered, someone will be looking for you. That's a major screw-up that will almost surely cost someone their job. If you go back and see them first, they may be greatful enough to give you a deal on a Sigma.
 
Greetings from the Oregon Coast!

First off, be honest. Call the manager of the store, and explain your story to him.

Second, realize you are probably not going to get a Smith for the price you paid once everything is sorted out.

Third, ask the manager just what kind of a deal he can cut you on a Sigma. Point out that you came to him before the store realized a mistake had been made, because they probably would eventually.

Maybe he'll give you a good deal, maybe he won't. Maybe he won't even acknowledge a mistake was made. The bottom line is that you have to tell the manager of the store what happened.

OK, I know I have to take the gun back cause I cannot run around with a gun that is not registered to me. However, they cannot sell this gun to the guy it was intended for because it is no longer a new gun.

I know enough to know that someone's head is going to roll. I also know the stores FFL is in jeopardy. Your all right, I want them to make it right and I want to keep this gun. I don't think I should have to pay a new gun price either? I don't think I have any responsibility in them giving me the wrong gun.

Thanks for all the good advice. I hope I remain a Sigma owner.

Just go back and explain it as you showed it here. You obviously aren't into handguns, and like you stated, you can't tell a shetland from a hereford and they may offer you to pay a little more to keep the Sigma. They will offer the other purchaser another Sigma, and they will correct the problem with your purchase based on your honesty and bringing it back. Turner's made a mistake with my Sigma purchase and they gave me some complimentary ammo for coming in. My situation was just a missing signature or something like that. Make sure you go back as soon as you can.

How exactly would one go about teaching a 20 year old woman how to use a handgun if their own level of knowledge was such, that they couldn't tell a Hi-Point from a S&W Sigma.

That sorta sounds like the kind of training, that would be more dangerous to your daughter than a random encounter with a mugger or rapist.

If you can't tell the difference between a Hi-Point and a Sigma laying on a gun counter...Perhaps you need to seek some training...Before your attempts at training others puts them in jail, a hospital or an early grave.

Perhaps if the guns were side by side the differences would have been obvious even to a person who has had no need to be able to identify different makes of the same style handgun. This however, has no bearing on my ability to load a magazine, point a gun and pull the trigger. I can chew gum and walk at the same time.

I haven't re-built a small block 350 in 20 years but I still can read the words Craftsman or Snap-on on the side of a wrench.

Nobodies THAT STUPID. There's an element of Spun B.S. here.

I am not trying to call anyone stupid here but the difference between a Hipoint and a Sigma is like saying I wanted a VW bug and paid for it and they gave me a Vette and I didn't know the difference.....
and then you are going to train someone else??? There is just something very wrong here!!!

WOW! This is a fiasco! Unbelievable!

I think you should talk to the store manager asap (not the salesman).

With a little luck, you will be a ligit sigma owner soon, but you must talk to the manager. I'll bet they offer you a good deal; it's now used and useless to the store and the poor guy who originally bought it. Hopefully nobody gets their head chopped off at the store for making this mistake (unless he or she deserves it).

Whichever gun you wind up with, start out by reading the owners manual cover to cover; then, read it again. Learn it inside and out.

Hope it all works out OK. Let us know.

This is not good for you or Turner's. Two employees signed off that this was your gun. However your gun is still at the store and has been registered to you. You now possess a gun that you did not pay for and is registered to another person.
Get back to the store asap and talk directly to the manager.
Heads will roll I'm sure.
I've never been given a gun without a model and serial number check before signing off on delivery.
If all this is true, someone has grossly violated handgun delivery protocol.
Make it right and don't expect to be compensated for doing the right thing.
BTW if you want the Sigma it is another 30 days before another dros can be submitted and then 10 day wait after that.

welcome aboard ted - hope these negative comments from members have not dulled your enthusiasm or your daughter's to the world of hand guns - as I see it, you relied on the store clerk to assist you since you admitted lack of knowledge - they made a mistake and you did not know the difference - how was you to know sigma was not a hight point? so many corporations have so many companies - hopefully the rest of your dealings on forum will be more pleasant - again welcome aboard
