Partial Win - Otherwise Loss in NY Carry Appeal

NY hasn't gotten away with it… yet.

I don't think they will.

Really? 18 year old adults can't buy even a Ruger 10/22. New applicants for Permits have to pay way more, attend classes, and can't carry in public places. Buying ammo, any ammo, even a brick of Thunderbolt .22, requires a background check and a fee.

They got away with it. They will continue to get away with it. And if the Supreme Court doesn't stop them, what the hell will?

Maybe the DOJ? :D

If SCOTUS can't force them who can?

For better or worse, SCOTUS only lays down in its holdings the minimum required to uphold or reverse a decision in accordance with the Constitution (or federal law in non-Constitional cases.)

And while a written decision may be long, only the holding is law.

So, in Bruen, the holding was that citizens have a right to self defense outside of the home and that that right includes, for law abiding citizens, the right to carry a firearm, and so shall issue is required and may issue is a violation of the Constitution.

The verbiage about not overly restricting the Constitutional right to carry a firearm by restricting, for example, where it can be carried, or how onerous it is to get a carry license, is guidance, to be refined by further litigation.

SCOTUS is much more likely to accept a case when different circuit courts of appeal come to different conclusions. That is happening now, with, remarkably, the 2nd and 9th in disagreement.

See my post immediately preceding this one.

Remember how long it took from Heller to Bruen?

I don't think it will take that long this time around since I believe Constitution abiding Justices avoided taking 2A cases while they believed that they might not have a majority, and until Trump got his three nominees on the bench it was 5-4 at best. Now it's 6-3.
