Police Officer Caught on Camera Doing It Right

I disagree with the people who do these things trying to provoke a reaction from officers. Did I hear that the city was Oceanside, California? I understand that the laws in California are very different than those in Georgia. I believe OC with an unloaded weapon is legal there?

Even though it appears that the officer was reasonable, if that happened in Georgia, the officer would be in gross violation of state law. As I pointed out in the other thread, the State Ct. of Appeals has ruled that possession of a firearm is not reasonable suspicion to disarm a person, or to require him/her to show ID. That officer, as nice and reasonable as he seemed, violated that person's rights under the 4th and 5th amendments multiple times. I equate singling out a person who is carrying a firearm in a state where it is legal with racial profiling. Most everything he did after he asked if the person had a permit was a violation. In Georgia, it is no more illegal to carry a firearm than it is to be black. Only difference is that you don't need a permit to be black.
 
Now, if I read this right..

So the stop was for a vehicle check; vehicle involved in illegal activity? If so, checking out the driver would be necessary.
I've only seen two people, in my life, doing open carry, and they were friends of mine. The thought of Open Carry would worry me
that someone had a NEED to do so. Since the rest of the public is
not OC'ing, I want to know, "What's the special occasion?" Carrying a gun AND refusing to identify yourself, sounds like a REAL long afternoon.

Unlike Tennessee, open carry is legal in California with no permit. To carry concealed in California requires a permit by going through the county. From what I understand a permit can be difficult to impossible to obtain.

If confronted with the choice of going unarmed or open carry, would we all go unarmed everywhere other than on a "special occasion"? And would we consider ourselves open carrying as some bizarre provocative behavior worthy of being stopped and interrogated everywhere we went? In none of the vids (and the two I posted were from Cal) is there any indication of behavior that warranted a stop. Here are some of the questions and comments among the vids. Not quotes but close enough.

You are part of a group.
Why are you carrying a gun?
What kind of a gun is it?
I'm taking the gun
Are you a marine or cop?
Do you have a license to carry?
Are you recording this?
Get up against the wall, hands over your head.
Are you trying to make a point?
When people see you in passing you should tell them your gun is unloaded so they don't freak out.
These are the Holidays and we don't know what your agenda is.
Do you have anything else on you?

On and on and on...

Is turning on the vid camera such an unreasonable thing to do when this what you can expect while walking through an apartment complex with your dog and woman... walking down a sidewalk... sitting on a downtown bench drinking a cup of coffee? I don't blame the cops for responding to a man with a gun call. They have no choice and it's their responsibility. But I certainly don't blame those who OC for getting tired of the BS and running vids as evidence that something needs to change.

In Tennessee we have the choice to carry open or concealed with a handgun permit. There are 13,000 active permits in my county. I never see anyone OC. However, if the choice was being unarmed or OC, I would chose OC.

Right on!! I think the officer did a great job. I do think that the gun owner didn't help our cause. I'm all about carry as well. I just don't care to advertise that I'm carrying any more than advertising that I'm not carrying.
 
Once he saw the cop was cool and on his side, he still persisted in being a jerk by not giving him his name, I guess to bait him further....for that, I'd say he was a dick.

Yep, I'm not a police officer, just raised around them. The police aren't trying to be jerks, folks.

The only part(well maybe not the only part) I didn't like was where the officer was pointing the gun towards traffic AND even another cop across the road, while he was trying to open the slide.

First of all, I DOUBT this idiot in the video was a former Marine. he sounded like some moron who sits in Starbucks all day. Secondly, anyone who walks around intentionally trying to provoke a cop is a tool. Things like this don't help gunowners. They make us ALL look like this guy. Finally, it's perfectly legal to stand outside the funeral of a slain soldier who died in Iraq, and call him a baby killer, but I'll bet that most of us on here would have a problem with it. it's also legal to breastfeed a child in public, but I'll bet most of us would prefer the mother doing it sitting at the table next to you at the restaurant be more discreet. The guy making the video is a tool who needs to get a life.

I agree. I am not a lawyer, and maybe he did violate some rights. In this case, I really don't care. He didn't do that guy the slightest harm and he did his duty to protect the public - with class and style. I can't fault him, but then, I think OC in general is misguided. Not my business to judge others. By misguided I just mean that I consider it unwise and that it does not interest me.

OK, We know trying to get a concealed permit there is next to impossible unless you are an anti gun woman member of congress.

So if you carry concealed, you just broke the law.

However, you can carry openly as long as the gun is unloaded. You can also carry the ammo on your person.

Carrying openly allows one to have a gun with which to defend themselves.

I also understand that the gun is unloaded. An unloaded gun does not shoot. There are about 30,000 people on here that insist on carrying a box of ammo in 5 magazines on their person so they can do a speed tactical reload in the event of magazine failure. So apparently a non working gun is not going to be a hinderence to a large segment of gun people. So if CA resdents have time to load the gun, it is better than not carrying anything.

When put that way, yes, it makes sense for Kalifornia no doubt. But not for a real world. NOT for the USA where we are supposed to have a God-given right to self protection codified in the 2d Amendment to our our much beleaguered Constitution.

And if you do need that gun you may very well not have the time to fish out the magazine, pull the weapon itself, seat the mag and pull back the slide to chamber the round and bring the gun to bear on... what? You are probably down by now and the perp has another weapon.

THAT is what I mean by really, really stupid. Not to mention (so I will) the fact that you make yourself stand-out in the crowd, becoming the likely first target because you are 1) sorta armed and 2) have something clearly valuable on your person. The only "positive" aspect is that everyone else in Kalifornia is calling the police about you on their cell phones so you are likely to have a semi-permanent police escort as you meander about.
 
I thought the officer was very curtious although the dude filming was definitely trying to get something going. I thought you had to carry some kind of ID with you or at the very least I thought you had to tell the officer who you were if ask. I may be wrong.
