On 20 Feb. I went to a gun shop to pick up a shotgun. The shop owner told me that he was undergoing an ATF inspection, and could not give me the gun. The agent was gone but will be back on the 3rd of March to "look" at the shotgun.

Having paid off the gun-I am the owner. The gun is new in the box-has been on sale for two plus years. I have written to the NRA, GOA, 2nd Amend. Foundation, and my Congressman.

I'd call ATF and make sure this isn't a scam on the part of the dealer. What help has any of the people you have contacted so far given you ? Another idea you could try would be to tell the dealer you want your money back but will purchase the gun when he gets back in business.

Thanks,

I've dropped a note to ATF. Nothing from the other groups yet-but I just started sending stuff out today. I've dealt with this dealer since '93-so I think he's OK-he did tell me that he told the agent that a number of folks would try to pick up guns.
He knows me well enough to anticipate that I wouldn't just roll over on the deal.
I also sent a note to the County Sheriff.

You've been dealing with this dealer for 17 years, and you're calling everyone you can think of because you think he "might" be wronging you somehow? Why don't do ask for your money back and go somewhere else, as you've obviously ruined your relationship with that dealer.

Is the dealer's FFL under suspension? If not then I do not understand why he cannot sell you the gun. FFL's get inspected on a regular basis. I have never heard of such a thing, except in one case where they found wrongdong and suspeded the FFL until after an investigation.

I've been delayed a bit by back surgery-I'll be going back (hopefully) this weekend.

From what I hear getting audited by the ATF is a time consuming experience so I could see if agents were there @ that time he might wish you to come back the next day to complete the purchase.Being that isn't the case he should complete the sale and give you your shotgun. If the Atf is comming back he just has to show that the gun was lawfully disposed of to you. There might be more to the story like his FFL is suspended while he is under investigation.Demand your money back and buy the gun someplace else. Save yourself the heartburn......God Bless....Mike

It's time consuming but does not close you down.

My EXPERIENCE tell's me this mans license has PROBABLY been suspended.... and he does not want to tell his customers that and have to start explaining and have everyone running around town making the story bigger.
He could be under say ............. a three week suspension for something as STUPID as someone not spelling out their complete middle name on yellow form......... trust me. Mistakes in his log book.... they can find something but usually if under suspension it was for multiple reasons. Too much to go into here.

I agree he may not even want to sell you the gun now if you have everyone from BATFE to the County Sheriff on him.

If you happen to know his FFL# from a previous purchase/transfer, PM me and I'll let you know if it is under suspension.

If the Atf is comming back he just has to show that the gun was lawfully disposed of to you.

That is what dealers keep log books for.
ATF already KNOWS where the gun came from. You log it in the day you receive it and log it out usually after the days business is done.
