Haven't taken it to the range yet but as of yesterday, I now own another S&W in .40S&W. Chiefs Special CS40 stainless in VG condition with one mag but no box. :( $328 out the door with taxes and NICS check included. Had not planned on buying it as I was only at the LGS to pickup my Uncle Mikes holster for the 4006. It called out my name as I walked by it. Tagged at $395 and owner of the shop offered it for $300. Could not resist.

I have a silly question, though. You said "$328.00 out the door with taxes and NICS check included". Did the gun store add a charge for the NICS check or is it just the way you typed it that has me confused?

Florida does the NICS check thru the Florida Dept of Law Enforcement. Stores charge between $5, which is what FDLE charges the LGS to run one, to $8 which is the most allowed. $328 was total for all. Most of the shops charge $7, which is what we do too.

I've never heard of that. In MA and AL, the store just calls the FBI directly, so I thought that's what everyone did.

If we wanted to do that, it requires more paperwork and everyone who does one here, has to submit to more FBI paperwork to gain access. Easier to let the state make the judgement call and if it is a Conditional No, do the whole check. We've had 4 CNs in the past 3 months that later were changed to Proceed. We have the paperwork ( OMB No. 1110-0026 ) in hand to do it, but can't really see an advantage at present.

When we call in on a 4473, we get either Approved ( equals the FBI Proceed ), Conditional No ( Delayed ), Denied. The approved NICS Number is XXXXXXXA where X is a number. Conditional No is XXXXXXXXCN. Denied is XXXXXXXXD I believe as we have no Denieds yet. A CN means in 3 working days, the FDLE will give an approval or denial. If no response from them after 3 days, it is up to the FFL if they wish to transfer the gun. A Denied means the person will have to file an appeal with the NICS number that was denied to the FBI. ATF provides a card for giving to a customer who gets turned down. It is also is covered in ATF Publication 5300.4 page 226 and 227. To do the appeal, you also have to have fingerprints taken in most cases and submitted. And it all has to be done in writing or e-mail/fax. They will not discuss it on the phone. They have 5 working days to provide the reason for your denial after they get the appeal. Then it is up to the buyer to provide corrected info to them for reconsideration.

Good luck to your friend as it could be something as simple as two people with the same name in the same county. A common CN cause is not giving a SS number and two people sharing a name. When I bought some property in Orange County, FL, I had to file a Not Same Person affidavit due to several bad apples with the same name.

Okay? you're joking, right? Man, that is a major score. I don't
think I've ever seen a CS that cheap. And it looks to be in good
condition...Totally jealous.

In looking for something else last night, I found my receipt for the polished 645. $495. At the time I thought it was high but now think it too was a steal. Too bad that 645 has now lead to spending a couple thousand more. For a 59, 659, 5906, 4006, and this CS40.;)
 
Thank you for the explanation. In my friends case it might be that there is another person with the same name, a similar physical description, and a criminal history. The differences are the bad guy is 20 years younger and lives in FL.

He's going to go through the appeals process, but he's not happy about it. Funny thing is that he's bought several guns over the last few years when he lived in CO and had no problems.
