Yes the dealer would be obligated to refund your money. He would have to get his back from who he purchased it from.

sometimes it's a mix up in the S/N also.

How would a NICS check pick up on it? The NICS system evaluates the buyer not the firearm? In fact, no information about the firearm is given to NICS, just the statement of "handgun," "long gun" or "both."

Evendently some states are different. In Tn we run the information thru TICS, and then TICS types the info to NICS. When NICS responds to them, they then give us a proceed or denial.

What Tn does is charges use 10.00 for the check. TICS requires all info on the 4473 and that includes all info on the gun. So if a gun is stolen they pick up on it and we get a call.

So I guess it's like a state deal with us.

By the way, we had one guy denied due to a unpaid parking ticket. I think Tn uses it as a collection agency and a way to catch any stolen guns.

In Ohio we fill out the 4473 and the dealer calls in the NICS check. The only information on the gun is "Handgun or Long Gun". There is no Ohio check. It sounds like Tenn. is registering guns.
 
It is suppose to be illegal for them to keep any records over night. Key word: SUPPOSE TO BE.


I think the same thing sometimes.

In one of our adjoining sates MS don't have pay any fee and only uses NICS.
 
I MO if you buy a gun that turns out to have been stolen for some reason a pawn shop is not required to refund your loss, but a gun shop is required to refund your loss. In MO the pawn shops are not looked on in a favorable way by gun shop personnel and owners.

Also MO does not require NCIC ser# check for sale of a used gun.
 
Why would a pawn shop not be required to refund your money also? You lost me on that one.

Pawnbroker law requires that pawn shops report everything they purchase. That's the Law.
 
I Had a gun that was purchased from a pawn shop who had it for 2 years. It sat in my safe for 5 years when I sold it to another pawn shop. 2 weeks after it sold the owner of the pawn shop said they where notified by the local police that the serial number was on the stolen sheet.

He said that they track stolen guns by serial number and not make and model first.

Since there are different guns from diffrent manufacures with the same serial number it will most likely come back as the wrong gun.

2 years later I have not heard a word about the gun. I go to the shop every Saturday, so I guess it was the wrong gun.

It's not uncommon for different manufacturers to use the same serial numbers.
In fact at times I have run serial numbers that came back stolen but after checking the make and model it's not stolen after all.

I worked as a police officer in the late 80s and still work closely with the agency. Although I'm currently a City Council Member.

I think from alot of post different states have different laws.

I would bet our state don't break even on the 10.00 per transaction they charge dealers.
I think they misuse the system and also it gives somebody a job.
