Wasn't sure if this is the right place for this thread.. I'm in the land of (cuomo)... I'm well past a half century old and i've run across guns(HANDGUNS) that were unregistered, but clean (I have always pass them up) When you run across these type guns is there a way to make them legal ? Here in N.Y. if you find one you're in possession of an unregistered firearm (FELONY) even if your intentions are good.. I'm in the Catskill Mountains not N.Y.C...

You can get the gun registered, but it will likely mean surrendering it until the paperwork shuffle is complete.

I met a guy that that happened to. An old man he knew died, and the widow told him she had a gun that had belonged to her deceased husband.
She didn't want it and asked if he would take it.

The gun turned out to be a Smith & Wesson Heavy Duty revolver from around 1950. The man had bought it new In the early 1950's and had never gotten a pistol license or registered it.
If I remember, he had to turn the gun in to the sheriff's office while they ran the serial number and checked out the gun. After it came back clean, he was able to add it to his pistol license and bring it home.

CERTIFICATE OF NON-DESTRUCTION
From time to time, handguns are found in the county or brought into the county under circumstances that are not criminal in nature, such as finding a handgun among possessions of a deceased licensee or purchased/brought from another state. Penal Law Section 400.05 requires destruction of weapons that are not properly registered. Persons possessing such unlicensed handguns can be arrested, therefore, the weapon(s) should be turned into the Sheriff’s Department for safe keeping and proper registration of the handgun can be obtained. A procedure has been established to permit individuals a means of applying for a Certificate of Non-Destruction from the County Court. Individuals can apply for this by either contacting the Pistol Permit Clerk or the sheriff’s Department. Once a weapons check has been completed by the Sheriff’s Department, the Sheriff will submit his recommendation at which point, the Judge may sign the Certificate of Non-Destruction. The individual will be contacted to complete the process by having the weapon registered on their permit or that of a licensed individual.

You turn them in here and you'll never see them again! And you say the judge (MAY SIGN) That means s you (MAY NOT)get them back.. On the way to turn them in your in possession of an illegal weapon. Depends if you turn them into a good Deputy or a bad Deputy. Just seems like they would want to have the gun legalized, but then in NY they want to destroy all of them

Unregistered handgun

The unregistered NY handgun can be taken to a FFL holder in a gun friendly state and registered legally to a resident of that state, like Pennsylvania. I don't know NY laws but there must be some mechanism for a NY FFL holder to get a gun from a Pa resident and legally transfer it to a NY citizen.

I might check into that further, but your still in possession until you reach a friendly state

MOVED FROM NY TO FL

In 2003, one of my first stops was to the local PD to declare/register my guns. They looked at me like I had 2 heads. I buy/sell a few (small scale) NOT for profit. I stay within the letter of the law and certainly do not want to buy a hot gun, nor sell to a criminal. All that's required here (to my knowledge) for hanguns only, is to look at the buyers drivers license to see if he/she is of age and is a Fl resident. No bill of sale is required and asking/demanding one can be a deal breaker. I have several in my possession now, others sold, that I don't have a clue if they are hot or have been used in a crime. I doubt the police would know either on many of them. I wish they would make a way for casual buyer/sellers to look up a DO NOT SELL TO LIST that, would be simple/fast/free, instead of tracking the good guys. TOO simple, Make too much sense?

Contact me and I'll give you my FFL licensees address. Sent them to him and I'll take them and you problems are over. I will have a friend in the P.D. run the serial number to make sure they're ok.
We don't have any of that kind of B.S. here.

I've always pass them up. Don't have any unregistered ones, but i do know where some are and i know they're clean, I don't mess around with something that might be dirty.. I have some LEO friends here and they cannot run numbers anymore.. MAILING a firearm is very risky in NY....But if it meant legalizing a collectable (MAYBE).Here in NY we can't even sell a hunting rifle to a friend without going through a dealer to do background check and they have to run it through their books..They started that so they know where every gun is so when the time comes they can confiscate them

When my Dad passed in 2009 when I was going thru his stuff I found a war capture of Japanese manufacture with the paperwork. I know my dad never had a pistol license and this gun had been tucked away for over 60 years and long forgotten.. this is what I did.... If you have a pistol license you can take the pistol / revolver to the licensing authority (In Putnam County NY its the sheriff) explain the circumstances as to how you acquired the gun they will do a background check on the gun if it clears (not stolen) you can put it on your license.

WE DO WHAT WE HAVE TO.

Don't get me wrong, I much prefer NOT having to register guns here in the gunshine state, than states like N.Y. I have some cousins that live in both NZ, and Australia. The ones in Aus don't hunt. Some of the ones in NZ do, hogs primarily and he distills his soured corn bait into a liquor called Davies Gravy. Ever heard of it? He supposedly got a contract to make it here in the U.S. in Tenn.

This year I have bought a Colt National Match and a pre 27 S&W at LGS'.

I did the paperwork, the Feds were called and they promptly and nicely approved me. Thank you Feds. I settled up and walked out with them.

Life is tough, it is tougher with stupid politicians.

I feel for you folks who live in states who have abolished democracy.

kenv1950, if you're anywhere near the lower Hudson Valley(Westchester-Putnam-Rockland) send me a PM, I can get that taken care of for you by my retired LEO FFL friend.

Or as Eagle 477 said, here in Putnam, the Sheriff will do right by you. There's no better Sheriff around.

As I believe, here in NJ you are required to obtain a permit to purchase a handgun. You do not need a permit to own a handgun as long as it and you are legal (non-felon) in NJ.

Unregistered firearms can legally be brought into NJ as long as the above mentioned criteria is met.

The above is not legal advice and should not be taken as such. I have been wrong in the past.

I would suggest you talk to either an attorney, your local Sheriff, or the NRA (which is a great source of information on various state gun laws) so you can be absolutely certain of what you need to do.

I feel your pain. Here in the Peoples' Republic of Maryland, we also have an array of overlapping gun laws, along with bans on certain firearms and a state board that maintains a list of which handguns can be sold here. It can be very confusing, but only to those of us who care about obeying the law, of course...
