Man arrested after tackling shopper carrying gun

Daniels' got a purty good civil suit again Foster and the others that join'd in the melee,
Walmart may be writing a check to Daniels as well.

I guess Foster's gonna get his 15 minutes in the spot lite.....

I try to stay out of Wally world, but when I have to go, I have a can of Mamma Rositas trusty re-fried beans. I'll bet that choke hold would have been a lot shorter if this gent had prepared himself with some of those.

I thought Florida had a battery on a old person=felony clause of some kind. Anybody know if this is true?

Battery on a person 65 or older is a felony in FL. We use that one alot.
 
I'm a big strong exercise fanatic who went to college on a wrestling scholarship. If someone attacked me from behind and put me in a clean choke hold I wouldn't do very well either.

watching the video you would of had Foster on his back before he knew it. lol
 
While I'm hoping that the would be hero is sued....... I can see no reason to sue anyone else but him.... & WalMart's only connection is that it occurred in one of their stores........big deal...........that could have happened in any one of a number of Mom & Pop owned & operated businesses, and few would be urging them being sued because someone committed a crime in their business.
 
If I were the victim, I think I would have severe nerve damage in my neck. It would be so bad I might never be able to work again. My quality of life would be ruined. It would impair my ability to have conjugal relations with my significant other, etc., etc, etc, etc
Seriously? There's plenty here to get the guy on. No need to make stuff up.
 
Yes, for heaven's sake, it isn't Walmart's fault - they were victimized by this character too. Leave them out of it, unless the manager was in on the "pig pile." :D

Here we have a law abiding gun owner who was attacked by a criminal. As I see it, Daniels would have been well within his rights to put a controlled pair into Foster. It didn't happen though, did it? Why not?

The reason is simple, Daniels wasn't prepared to handle a situation like this. He wasn't aware. He wasn't ready to get his gun out under stress. Even when under full assault, he made no effort to defend himself.

Obviously this is a major fail on Foster's part, but it should be a wake up call for the rest of us. Had this been a true attack by a criminal intent on harming Daniels, his gun would not have helped him at all. In fact, after the criminal dispatched Daniels, he would have had a gun.

No one can be aware of everything all the time. We'll all get caught depending on the situation. Still, there are things we can do to prepare for this. Some empty hand training is valuable like the Focus Training seminar. On going training and practice is better. Remember, just having the gun is not enough. You must be able to bring it to bear.

I think after the initial shock Daniels was aware. Foster was yelling he had a gun (Daniels) .And Daniels was shouting he had a permit. Maybe that is why Daniels did not put up a bigger fight.
 
I'm not an advocate of frivolous law suites (unless they benefit me :)). The goof that tackled the the older gentleman is a victim of the intense media war on guns and legal CC. I've seen a couple articles on this incident trying to link it to a racial thing. Even drawing comparisons to the KKK. Financially crippling lawsuits need to be filed against the media that increasingly incites to riot and influences the weak minded.

I agree. Further, inside a busy store, during daylight hours, is a very unlikely time for something like that to happen. Even so, as soon as you feel the grab, some action should be taken.

No argument, but it did happen fast, then two more joined in to hold him down. He did say he had a permit.

Maybe what he did was the correct move, who knows, I sure don't.
 
I wonder if the elderly man sustained some serious and lasting injuries after being viciously assaulted by this obviously deranged Michael Foster. I wouldn't be surprised if there will be a civil lawsuit in the future. I can recommend an attorney in Florida with the tenacity of a pit bull. That would be my cousin Butch. Michael Foster's criminal proceedings may just be the beginning of his troubles.

Watch that "elderly" talk, bub...at 61, I'm one year younger than the victim in this case, and I sure as shootin' ain't "elderly"! :)
