CO arrested in NJ

I'm pretty sure the Mayflower landed on the coast of eastern Colorado, where Plymouth rock is located. (Massachusetts born and raised)

Do the BAD GUYS go by this ? If I have a permit the cop should say have a good day . Not put a good guy in jail for 5 years . I would not go to NY how did they get this way.

Yeah, and let's not forget the battle for the Alamo over there in Newark!

Lol more like the battle over Paterson. Now that's the real gem of the Garden state.

Simple: If you can legally possess and own a handgun....
You may carry it concealed or openly, with NO permit required.
Right but you still have to know the laws if you plan to take your gun. It's as simple as that. I do not agree with NJ laws but I know them and know what I can or can't have when I enter that state. Same with the CO.

Your phrasing could open a can of worms...

As I have said before, the people of New Jersey have forgotten their proud history, Lexington and Concord.

Lexington and Concord are not in New Jersey. They are in Massachusetts, which has even MORE restrictive gun laws. If these laws were in effect and were obeyed at the time, there would have been no American revolution and we'd all be paying alot more for tea.

If you are dumb enough to not KNOW the laws of the
state you are in should you even be carrying at all?

This isn't rocket science and we are talking about a weapon
are we not?

Some folks make it awfully hard on the rest of us who are
responsible gun owners.

Not everyone is cut out to carrying a firearm.

Chuck
Hey Chuck,
Spot on.

Ignorance of the law isn't an excuse. I have a hard time thinking that there's still folks out there that don't know how anti gun NJ is, even more so that this guy is from Pennsylvania. I mean you have people in this forum from far away states that know this.
I know this and I make sure to keep my driving West of the Delaware River safe inside of the confines of Pennsylvania. I understand and sympathize when those from far away states make the mistake of going to NJ while carrying (to a certain degree) but how someone from a nearby or in this case, bordering state, makes such a foolish mistake....I credit that to being a bad gun owner and not doing your homework.

I'm not an expert on either states gun laws, but from what I've been told is MA actually gives out carrying permits, whereas NJ rarely if ever does.

It is very simple, I stay out of any state that does not recognize my CWP and violates the 2A. Also If I owned a firearm manufacturing business I would be looking for a gun friendly state which would be just about any state that democrats do not control.

Seventy-two killed resisting gun confiscation in Boston! | Fauquier Free Citizen

Boston – National Guard units seeking to confiscate a cache of recently banned assault weapons were ambushed by elements of a Para-military extremist faction. Military and law enforcement sources estimate that 72 were killed and more than 200 injured before government forces were compelled to withdraw.

Speaking after the clash, Massachusetts Governor Thomas Gage declared that the extremist faction, which was made up of local citizens, has links to the radical right-wing tax protest movement....

Gage issued a ban on military-style assault weapons and ammunition earlier in the week. This decision followed a meeting in early this month between government and military leaders at which the governor authorized the forcible confiscation of illegal arms.

Even if he were a police officer covered under LEOSA, he could still be subject to arrest. LEOSA provides an affirmative defense to conviction, not arrest. I would not travel armed anywhere in the Northeast (except Vermont) without an expectation of trouble outside NY if stopped by LE while armed. I would also tell my LE buddies from outside NY that it's a coin toss as to whether they would get through NY unscathed if armed. I believe in the universal application of 2A rights for ALL law abiding citizens across all 50 states! One should be able to travel armed in any state as long as one is obeying the law otherwise. His/her 2A rights are a matter of constitutional FACT and NO state should infringe upon those rights. Rant over.

It's an affirmative defense, but it will also be a costly on for the department that arrests someone legally carrying under LEOSA when they get sued for a false arrest.

Sheepdog Academy is an organization centered in NJ I think, that has sued departments for arresting someone under LEOSA when there was no basis for arrest.

In one law suit, I read where anyone from the officer on up the chain of command will be held responsible for bad arrests.

I'm a PA LEO and go to NJ and NY frequently and have no worries about carrying in either state. If some bone head officer in NJ or NY wants to arrest me, go right ahead. Your department will be writing me a huge check!

I know in Pa CO can only carry when on official duty transporting prisoners. Otherwise they have no LE authority. However, in Pa you can get a carry as a civilian permit no problem.

He is not a cop and has no right to carry in NJ.

Must disagree with yourlast sentence. He certainly has a God given right to defend himself along with 2A "shall not be infringed". The problem is his rights are being violated.

Good luck! I mean that sincerely, sir.

Lexington and Concord are in Massachusetts but NJ still stinks for gun owners.

The good news is our governor pardoned the guy today.

True true but I wonder if that defense would work in court. Would you care to try?

The reality is that he or I or you have no right to carry in NJ

I lived across the street from Don Bosco on Union ave in the '70's. Except for Kennedy High down the street, wasn't a bad neighborhood, then. And I'm pretty sure the Battle of the Alamo was about them renting little cars that burst into flames when hit from behind. Joe
