Man killed with own gun

There is a reason why most LE holsters have security features. When I went through the Academy, we spent a lot of time focusing on weapons retention (for our cross draw holsters). Now that I'm retired I keep my weaponry out of sight.

It may not have been "open carry" but it certainly wasn't concealed very well.

17 years old, probably won't be tried as an adult, so the charges won't matter. He'll get "juvenile life" at the most and be out at 22 with a clean record.

Since they gave the juvenile suspect's name, good chance they'll try him as an adult.

A 17-year-old is accused of snatching a gun from a Dunkin customer in Georgia and shooting him to death in the parking lot, according to local reports.
Don't know if he was open carrying or not.

Georgia teen steals gun from Dunkin' customer, shoots him to death in the parking lot: reports | Fox News

From the article:

Witnesses told police that Orr saw a gun in Dykes' waistline and grabbed it from his pants just before 9 a.m. on Friday. Dykes reportedly chased Orr outside and a struggle ensued before the teen shot and killed Dykes.

Sounds like one of those ever so popular and ever touted inside the waist band holsters that are supposed to be so superior. Not an open carry.

If it want open carry the kid wouldn't even know he had a gun on him.

I see this frequently from people that apparently don't want to be bothered with having to deal with keeping up with a holster for whatever reason but still want it to be known, "hey ! I'm carrying ! Look at me !"

There are always freak occurrences from carelessness or just plain bad luck when one's personal protection piece may be inadvertently exposed momentarily, but overall concealed means concealed. If someone is casual about 'I don't care if someone sees it or not, I'm not doing anything illegal !' then the risk of being robbed of your gun or shot first as an obvious possible threat is magnified.

And as has been pointed out, chasing after someone who has just relieved you of your loaded firearm ain't the smartest of moves . . . .

Nothing to see here . . . move along.;)

There's nothing in the story that states he was open carrying (at least from what has been reported at present). FWIW, I've spotted people carrying "concealed."

When visiting KY a few yrs ago , my wife and I pulled into a convenient store parking lot. An elderly man was getting a walker out of back cargo area of his minivan. When he turned to walk in I noticed an open carry Glock (presumably a 17) on his hip. He was wearing shorts with his shirt tucked in. I remember saying to my wife " he has both hands on walker. Someone could snatch that gun in a second "…….. as for guy in article chasing after their. I understand how that could happen. You feel responsible for that firearm. Plus in real time maybe he didn't process that the guy stole a gun as opposed to car keys o cell phone. Anyway you look at it it's a tragedy.

I thought the point of the news article was one more PUNK thought he was big stuff. IF we are lucky he will spend a few years with Bubba and never walk the streets again!

Silly comment. One anecdote here or there doesn't mean a thing.

I wasn't there, and didn't see it; so I clearly don't know what I'm talking about; but my knee-jerk response was the victim didn't have his mind right----he wasn't prepared to shoot---and shoot to kill.

Of course, if he had done just that, it's more than likely he would have been arrested and prosecuted for murder---as in win some, lose most.

Maybe not in GA.

Superior Court Jurisdiction over Juveniles: There are certain limited circumstances under which a child under 17 may be tried as an adult in Superior Court. This can happen in one of two ways. The first is when a child is charged with one of the "Seven Deadly Sins," which are very serious offenses. In those cases, the case originates in Superior Court but may be transferred back to Juvenile Court. The second is called a "discretionary transfer" wherein the juvenile prosecutor asks to transfer jurisdiction to Superior Court. Whether to try a child as an adult is discretionary on the part of the State, so it is crucial to retain a Georgia Juvenile Attorney who will work to have the case heard by a Georgia Juvenile Court. Just a moment...

Also not necessarily in NM:

32A-2-3 NMSA 1978
H. "serious youthful offender" means an individual fifteen to eighteen years of age who is charged with and indicted or bound over for trial for first degree murder. A "serious youthful offender" is not a delinquent child as defined pursuant to the provisions of this section;

Living in NY state and knowing the ground rules that apply here a civilian should do everything possible so that nothing shows. Many people in this state in a urban area if they think they saw a weapon they will put in a man with a gun call.

Depending on the LEO/s and/or the department and even the mindset of a DA, a good chance your gun will be confiscated just because it showed. Next step you go to a judge who in many cases will cancel you CCWP. Then either the cops will confiscate any handguns you have or you might be given a couple days to legally dispose of them!

I learned long ago concealed in this state means in pure English no one know your carrying unless you tell them like your stopped for a traffic charge or they pat you down or wand you.
