I consigned two guns to Jim during the June 2024 symposium. Jim readily admits that he owes me $1858.10 but that on the advice of his attorney, he will not pay me.

I hope I am wrong, but I know of only one “bad habit” that could cause these amounts of money to simply disappear.

But there is an expecting father involved here that consigned guns to pay for out of pocket medical bills associated with his baby’s imminent birth. Think about that.

I have seen more than a few members here get financial assistance over the years from our generous community, when either a flood or other event has caused them financial ruin or hardship.
I believe this community can rise up once again and offer assistance. Please let him know if we can help.

A thought that just occurred to me. And I don’t know if these circumstances are applicable…

I have insurance on my collection through Collectors insurance. I’ll be reaching out to them later this week. And I will update. If anyone affected here has insurance on their collection it may be worth looking into.
 
Back to the bonded/insured aspect. Why am I thinking that these criteria were a mandatory requirement as an auction promoter and collections dealer?
 
It is extremely sad to read through these posts. I have known Jim for many years and have both purchased and sold many times on Sarah15. The number of clients affected and the amounts mentioned are extremely disturbing. I am also on the short end of being paid and have other items he has yet to sell. Based on past dealings and my interactions with Jim, this is all very hard to believe. As Lee so graciously stated, it is hard to see a friend crash and burn. Hopefully, someday the full story will be known and how this all got to this point and why. I believe the S&WCA Board acted appropriately. It is difficult that issues like this cast a less than positive shadow on this business and hobby. My hope that all those affected somehow get through this - especially those who this has hurt the most.
 
I’ve asked the administrator why Mr. Brewster is still allowed access to this forum. No response yet.

We want him to be able to communicate with people who consigned items and explain his actions. We pray that everyone is made whole.

We won't allow him to do business here and are stunned...
This has apparently gone on for almost a year and we only learned about it a few days ago.

I hope & pray that he does but, given that the grift has been going on since early 2024, that probably won't happen.

The hearing was on the 17th not 25th. His update was lackluster at best.

I received more information from the plaintiffs legal counsel on January 29th, most of it has been covered in this thread already. His name is Peyton Engel and his information is listed in one of Dave Thinnes posts. I did contact Jim’s attorney (per his instructions through multiple texts) on Jan 28th and I could not get past the gatekeeper as he has not given permission for his legal counsel to provide any information to his creditors.

The case information and records can be found in the Wisconsin Circuit Court website. The case is “Polk County Case Number 2024CV000026 Timothy Lawler vs. James Brewster et al”

Just wanted chime in here as someone who was affected by this situation.

On August 17th I was contacted by Sarah15 and they encouraged me to consign some firearms with them as Jim was going to be driving around the country personally picking up other consignee firearms. The incentive would be to save some $ on overnight shipping and insurance to Wisconsin. I have documented that Jim was going to make approximately 10 other stops during that trip.

At the end of August Jim and his son stopped by my house, picked up 14 handguns and 1 long gun, signed a mutual contract for consignment with me, shook my hand, and were off to the next stop.

All but 1 firearm successfully sold by the beginning of October. At that time, per our contract, I should have been paid out within 2 weeks of the new buyer inspection period. I asked them to relist the last gun asap but for weeks it went unlisted. Finally it was listed and I presume sold in late November.

In the beginning of December I got the same notice others received saying that my payout of approximately $11k-12k would not be able to be payed out as it would be viewed as preferential payment due to a lawsuit against Sarah15/Jim. I did my due diligence and found out that suit was filed in Wisconsin Jan 2024.

I’ve been promised that I’d be updated promptly and frequently on the case progress but I’ve had to be proactive in that regard. My legal counsel has been engaged as well as the moderators of this forum. The SWCA board is also aware of the details pertinent to my situation personally. I encourage any other people affected or concerned by this matter to contact the SWCA board and Dave Thinnes the gentleman who started this thread.

I call Bull*@,$ on his excuse that he and his wife are being sued by a consignor. When a person declares bankruptcy, they can’t pick and choose who they want to pay off because it would be considered a “preferential payment.” I would suspect a possible bankruptcy is in the works.
 
I agree the larger ones on Gunbroker,like Sarah15 should be bonded and insured for losses like this.He owes me over$6800.No disputes just non payment.Auction ended 11/3/24.I also believe bankruptcy is coming.That is why he formed a new LLC.When looking at the whole picture this should be A CRIMINAL CASE.He needs to be measured up for an orange jumpsuit.

Still owes the estate $440K and has for a year

I’ve been told by several sources the Trotter collection of guns you handled for the estate & consigned to him to sell was ~1400 guns. I did watch some of those listings of his on GB as he identified them being part of that collection. I never literally counted how many I saw; however, I seriously doubt he listed anywhere close to 1400 guns on GB from that collection, so I presume a large portion of them were sold privately by him for amounts you may or may not ever have accurate selling prices on.

The creation of a ‘perfect storm’ was set up, all based on trust, just like when I trusted him. Hope you somehow get everything back for Mr. Trotter’s estate that it has coming to it.
