CCW denied to a friend in AR

A very old friend was re-uping his CCW license in Ar and was denied after he had had it for 5 years: reason felony, convicted of stealing over 50 dollars in a Cassville Mo court when he was 18. He remembers it was downgraded to a misdemeanor with 6 mo probation, had to graduate hi school and get a job, he met all requirements. This was 1965, I have known him since he started working with us that same year. I have over the years sold him many S&W's as I had an FFL. He has since hired an attorney in Cassville and he can find no record of the case disposition, no final order and has informed the people in Jefferson City Mo to clean up their records and also the FBI records because if there no record it was ever proscuted and after 51 years the records need to be brought up to date. It looks like he may prevail in this but he will be out time and money. Plus he voted this year and has done many 4473 forms over the years since the GCA act of 1968, hope it all works out. NOTE on the 20th of May he was informed by the state of Arkansas they will be sending him his carry license the lawyer got the FBI and the state of Mo. to fix their records, I think it cost him close to 500 to get it done.

Court clerks and state bureaus can and do make mistakes. You should keep every piece of paper you ever get that has anything to do with court... for ever. Important papers should be copied and kept off site.
 
As opposed to making a big fuss about incorrect/out of date/otherwise messed up records, may I suggest your friend's attorney get together with a reasonable prosecutor, an equally reasonable judge, and have friend's record expunged---one very short letter which basically says it doesn't make any difference who did what when, the entire matter is now gone---never happened (as a matter of record). Step Two: Send a copy of the order to whomever it is that has their knickers in a knot---along with a cover note suggesting it will be in everyone's best interest to what the order says---forget about it.

The scary part is "felon in possession of gun". Scary as well is if it is in the system as a felony but no local paperwork to support the final outcome as otherwise.
 
Not to say this is the case here, but I am truly amazed at the number of people I see that claim never to have been convicted of a felony when, in fact, they have. I believe if I had a felony conviction I would remember it! On the other hand, I ran across a guy a few weeks ago who thought he had been convicted of a felony theft over 40 years ago. Turned out it was a misdemeanor conviction (we still had the records). Poor guy had passed on gun buying for all those years for no reason at all. Just shows what a ridiculous idea these background checks are anyway. The records are wrong or nonexistant about half the time. As they say, "garbage in, garbage out."
