Got DENIED purchase of a gun today, anyone else had this happen and appeal?

I also gotta add.another vote for having a CHP.

I know I could buy on my badge, but a lot of dealers are uncomfortable with it.

The CHP is way worth the upfront money to save subsequent headaches.
 
My husband and I both received our CC permits before we ever purchased a firearm, so I have not experienced the clearance issues you go through. For us, it takes about two minutes to fill out the paper and photocopy our permit. The next five or ten minutes is for the sales people to double and triple check that the firearm serial numbers match the paperwork and the case.
 
No I have never been denied, but I get delayed about every 2 purchase. I bought a SBH last winter and got delayed, a LH 24-3 last spring got delayed, a 629 last summer went right through, I bought a vaquero last May and it went right through, a 77/44 this January went through with no problems. Bought a 24-3 from am member a few weeks ago and got "delayed for further review, come back on thursday (it was the Friday before presidents day, so 3 buisness days",) but got a call on tuesday that I coud come pick it up. Got another one coming soon...
Who knows?

Thinking about why you were denied, I wonder if there was a data entry error on somebody's part? Perhaps your name was misspelled by the operator who took the call from your dealer?

FYI, all US Government agencies have a Congressional liaison office, folks whose sole job is to answer constituent complaints and inquiries from Senators and Congressmen. If you are dissatisfied with the way NICS ultimately resolves your situation, I would strongly suggest you contact your Congressman's office and ask them to go to bat for you.

Bushmaster1313 asks a good question. If you were delayed they will get back to you. If you were denied follow up is required from you to find out why.

2 felons in my old area had the same 1st and last name. That may be part of it they tell me, but, the blinkety blank SSN is different and they had no reason for not trusting it.

Once I bought a rough 22 at my LGS, was going to slick it up for one of the grandsons. The LGS called as I walked into the house, said the Feds called, they made an error you were denied, not delayed. I said now what, he said get it back asap. I walked in with it, fearing the worst. As I walked up to the register My buddy answered the phone, he looked at me and nodded, I knew they were talking about me, the term sweating bullets came to mind.

He said OK, he pulled the form out and made notes.

They said they erred and marked it deny and they meant to mark proceed, but they gave the gun shop proceed on the call. It ended up being nothing but it did tick me off I made some calls and they pretty well have themselves insulated from the world.

I post about the experience since most people who have brought up in the issue on forums elsewhere on the glorious interwebz had various youthful indiscretions, but my youth was not interesting enough. Never arrested, let alone convicted for any crime, however minor, beyond traffic offenses...and none of those for at least a decade.

I hadn't bothered to get a permit here because residents do not need one. After I clear up whatever confusion caused this I will certainly get one.

The NRA says something like 5 percent of denials are overturned on appeal, which adds up to thousands per year and cautions that this may be only a small percentage of the real number of erroneous denials, speculating that many do not appeal or follow through with an appeal.

I did one smart thing in my life when i got the Indiana Life
time Carry Permit when they first started them.
75 bucks and your good to go for life. (conceal or open).
Never had a problem and i've bought full autos before.

I regularly get delays. Got a delay in Pa once. They do their own checks. At the time I had a Pa explosives transport license and a Pa carry permit. . Trying to buy a rifle at Cabela's. . They called me back the next day with the approval...But 4 hours away so I thanked them and told 'em never mind. I held an FFL for 27 yrs previously. Surprisingly I had 150,000 primers and 80 lbs of powder in the truck at the time..
 
I was thinking that I needed a .44 Magnum revolver today. Much to ky surprise, I cake back as DENIED with a sbot delay. I had just l, in the past few weeks, purchased my Spanish Mauser and Ruger Match Champion. In neither case was I even delayed, though I have been delayed before.

I have no convictions, have never been arrested and have not so much as a traffic ticket in the last ten years. I have no idea why I might have been denied, and nothing of note has happened in the last few weeks such as being hauled before a grand jury, or even a parking ticket.

I filled out the online appeal form and it said I would be notified of the general reason for denial within five business days.

Now I feel like I have been branded with the mark of Cain for some reason.

Has anyone been through something like this, and been denied by mistake or some such and gotten it cleared up? I actually find myself a bit shaken and the shop was very much surprised as well since ai just gotten a rifle there recently.

What am I in for to try to get thus puzzled out and fixed? Is it possible it will be cleared up easily or am I facing some sort of Kafkaesque nightmare that will see me becoming a black powder fan simply because I will end up giving up?

Been a cop my entire adult life and I was 55 then ? Sent in appeal letter. Dealer called three days later said good to go. 6 months later got a letter from feds said issue was resolved so no appeal done ?

With my Wyoming permit, I just walk in & point at what I want. Give them a permit for a photocopy, fill out the paperwork & sign it, pay the bill & take home my new acquisition. My friendly conversation takes much longer than the actual transaction.

It makes sense you were delayed not denied.

NICS to buy a firearm is a bother, but I do not get bent out of shape about it.

If NICS were to be extended to ammo purchases -- that would rise to the level of an annoying inconvenience.
 
Me, I'd go back and get them to run it through again.
Or just get your wife to buy it for you-that's what my clients do :D

It is a sad day when a semi law abiding quasi sane citizen cannot walk into a shop and buy a .44 Magnum revolver on a whim, for protection against werewolves. That is what I thought about writing in the appeals form comment section. But then decided against.

Thinking on it, whatever record in the past got me variously delayed or further reviewed, it obviously caused someone to hit the deny button this time. So best I get it cleared up now.

It makes me feel better knowing other people had glitches happen to them too and had it resolved. I did write the Congresswoman and appreciate that tip. Not even necessarily a complaint per se, but a simple statement of "this happened to me and I do not know why".

I felt embarrassed at the shop, even though it was a dealer I had purchased from before. Thus did not ask them to run it again etc.

Meanwhile maybe I will save up extra while I wait and get a 629 mountain gun instead of that Ruger and make something positive of the down time....

I tell myself it an interesting experience anyway. I don't know how many guns I have purchased with the instant check over the years, but to give them some credit, whatever error is involved, it makes for a less than one percent situation and I do have some faith that the due process procedures in place will suffice to rectify things.

This seems to happen often enough that a number of attorneys specialize in the appeals, but they seem to charge $2000 to $2500 for it. A potentially lucrative sideline for some perhaps.

Thankfully, every purchase I've ever made, I was cleared instantly. I forgot what else I wuz going to say but will add, that having a boring bland name like I do, can be a blessing. :-)))

Maybe having Dweezel Moon Zappa as a name, ain't so bad after all. :D Just think what would happen if your name was William Bonney, Jesse James, Ike Clanton or Bob Ford? :D

Now, if your name was Audie Murphy, Davy Crockett, Daniel Boone or George S. Patton? you'd be denied for sure. :mad:
