The smart answer is that a "defense of your home" is not sufficient cause to discharge a weapon unless one is in fear for their life because the intruder is displaying a weapon in a threatening manner.
If this "intruder" is inside my home, you can bet the weapon will be discharged as I'm now in fear for my life, and anyone else's that may be in the home with me. Whether I see him holding a weapon or not is not my concern when I see a intruder in my home. The mere fact he entered my home is threat enough.
 
I just wanted to jump in here in order to say sorry to Seaforth for implying he may be fishing for things to use against us. It appears I was wrong about that and needed to say so. Sorry, man.

FWIW, I have never had to show my gun to any human being while at home or away.
