Is there any way to tell if a 39 has not been fired?

Not really possible to tell.

Mostly because they have ALL been fired at the factory.

The best you can tell is whether they have been fired a lot, or a little.

ALL semi autos get fired, at least 1 mag, some more. Revolvers too.

Revolvers get 3 rounds fired through them, not sure how many rounds get fired through pistols at the factory. The only ways to determine if a pistol has been fired by a previous owner would be to examine the slide and frame rails for wear and the rear of the receiver where the hammer shank whacks it during recoil. The more pronounced and deeper the whack mark, the more rounds fired through the pistol.

If it looks like it has not even had one round fired, then someone cleaned the snot out of it and maybe even refinished it.
