NM Gov orders no gun carry in most populous county

Looks like the ban only applies to state buildings.

No big deal. I have no objection. We had a case where an off duty LEO shot his wife’s lawyer in the courtroom.

I was personally involved in a situation where a lad wandered into a government office wearing a mini revolver on his belt buckle. Scared the staff, disrupted the operations of this section of state government.

Guns have no place in a courtroom or other government building.

My understanding from news reports is that the governor is utilizing a public health & safety law to justify executive order that essentially suspends the rights of citizens to bear arms, openly or concealed, as guaranteed by the New Mexico state constitution.

Unlikely to withstand any serious legal challenge. Unfortunately, such challenges require commitment, time, and significant funding to accomplish.

Meanwhile, I will stay on the north side of the border between New Mexico and my home state of Colorado.

Considering that she also eliminated qualified immunity for police officers in 2021, it will be interesting to see if any LE in NM will be willing to enforce a blatantly unconstitutional order when they can be held personally liable....

This E/O states that any transport of a firearm through the affected (Bernalillo County) area requires it to be in a locked container or secured with a trigger lock or similar device. And possession on private property does not appear to include motor vehicles if the vehicle is on a public highway.

How are state officials going to notify travelers on Interstates 25 and 40 and the state and county highways of this emergency order? I can see an instant revenue source for the state, county and municipal governments.

Also I don’t see any exemptions for LEOSA either.

You understand wrong. It is a ban on public carry, open or concealed, in Albuquerque and Bernalillo County. It is blatant tyrannical attack on both the 2nd Amendment and NM Constitution.

Here is the kicker: What LEO is going to want to enforce this? 1) this order is blatantly a violation of both the US and NM Constitutions, and 2) this same Governor signed away qualified immunity in 2021. Now, LEO's can be personally sued for violating civil rights. I can promise you that if I am accosted, arrested, or charged due to this "public health order" that I am bringing a civil rights suit, and personally suing each and every public official who participates.

After 35 years in ABQ, moved to the DFW area about a month ago.
Both daughters moved their families and the mother in law moved as well.
With the failed schools, lack of healthcare and good jobs, and the crime, it was past time to go.

Please read the actual declaration. Unless I missed it, there is no mention of guns in the entire body of the piece. The public health emergency is the result of illegal drug use. I presume if one reads the specific provisions of the public health emergency law is a ban on firearms in "public spaces" and that does not seem restricted to the buildings you reference. I'm happy to be corrected on this point.

So, what do we have?

A public health emergency involving drugs, not guns. A governor who openly acknowledges the declaration will have no impact on criminals and and illegal gun carrying.

I think there's a whole lot to object to in this cynical and underhanded attempt to legitimize gun control by linking restrictions on lawful possession to an illegal drug use epidemic and purporting it will reduce the crime caused thereby.

That's the way it's done. Let your foe spend his warchest defending against something that shouldn't be done in the first place. Solid strategy.

I'm going to assume that most folks don't have the resources or time for such suits, unless one of the bigger organizations take up the fight for them.
