Shooting robotic deer

Yes, but baiting a person into breaking the law is entrapment. In criminal law, entrapment is when a law enforcement agent induces a person to commit an offense that the person would not have been likely to commit otherwise.

So, I ask again, how is this not entrapment?

I realize that poachers are scum of the earth. I think they should be punished severely for their crimes. I also realize that the law enforcement in these areas is limited and that poachers are hard to catch. Even so, this sounds like entrapment to me and gives those caught with this method a way out.

I see the "bait car" in the same light. Obviously the cops wouldn't do it if they didn't gain some value from it. I'm sure most of those caught don't fight it hard and are happy to get off with a fine.

Decoy deer, elk, moose have been used for well over 40 years! Used to be a full body mount, right next to a fence. A guy would drive by, a shotgun blast with buckshot out the window, and the game was on.

It is not entrapment; you have EVRY opportunity to look the deer over and decide whether or not to 'bite'. Wardens are in fact usually very careful to place them where a driver will not stop and cause a wreck, as many people stop to take pictures of this really nice buck feeding off the highway.
A 'bait car' is very different. A car running up and down the strip, revving its' engine coaxing a guy to race/ promoting hooligan behavior is not right.
Liken the decoy deer to the street walker cop. She's there, in a skirt, and a fur coat strutting in high heels. It's not against the law to stop and talk to her. It's not against the law to ask her if she wants to have sex with you........ It's when you offer her money, or agree to trade payment for service that you have crossed the line.
Likewise; it's not illegal to stop and glass the decoy deer. You can in fact look it over with your rifle scope, perfectly legally. (If looking from inside the truck, the rifle better be UNLOADED, with the bolt removed.) You are not in violation of anything at this point. When you ventilate the decoy, then you have an issue and have crossed the line.

I have no idea of the legality of offering a decoy deer money for sex. :rolleyes: Results may vary depending on the county you are in. Some may even offer bonus points for all I know!!
 
I have a friend with the Division of Wildlife here in Colorado, who uses robot deer decoys. When an ethical hunter stops and views the decoy, then drives on, gets out of vehicle and legally stalks the decoy, they will stand up and inform him it is a decoy. They often thank the hunter for being ethical. There has been presidence of entrapment. A number of years ago, in another state, a decoy deer was mounted and used for these stings. Many hunters shot at them, and one hunter took his case to court in spite of video evidence against him. His defense was the fact the decoy was HUGE. In fact the judge ruled in favor of the hunter, claiming he was a hunter himself, and in all his year hunting he had never seen a deer that size and would have shot it himself. After that the big deer was retired and a small 2 point was used instead.
 
FT Hood uses the robot deer as well. We pulled over in our truck and saw at least 3 yahoo's taking shots at it (this was after our morning hunt and we were heading back to the check station). We wrote the license numbers down and kind of wondered why the game warden was not around. It turns out they had one filming the illegal activity an around the next bend was the game warden and MP's.
Later in the morning the game warden asked if we were "tempted" and wondering what we were up to? I said, "heck no, the way the bullets were hitting that deer we figured it was going to be looking for revenge"!!
 
They have been in use down here for many years. Mostly used at night, as many rednecks down here seem to think that no matter what time day or night "If its brown, its down". Taking deer after sun down is a big no no down here. I believe the lack of common sense seems to be the problem though.
 
One time I came around a corner on a national forest road in CO right into 3 guys standing in the road shooting at a deer/elk. I slowed down and continued past them. Had no desire to give them a law refresher lecture.
