ccw thru IL

I've never understood why Illinois doesn't care about the United States constitution. Furthermore, I don't understand why any state would want to restrict freedoms of other Americans; it's pitiful. We can't say it has anything to do with liberal politics, because there are other liberal states that don't step on freedoms of Americans the way Illinois does.

Here in the great state of Texas, we respect and honor every other states carry permits, because if some willywhomper from Illinois is visiting my state, and he stops a crime with his firearm, the state of Texas wins.

You better read Illinois's and Chicago's gun control law's before you give your opinion on what could bankrupt people with bail cost (if lucky instead of awaiting trial in a Illinois county jail), multiple court dates, lawyers fees, court ordered fines, imprisonment and in the end probation.

Best option in my opinion is to spend my vacation money in gun friendly states, not Illinois.

I'll admit I won't go to Chicago unless absolutely necessary, but that's not just because of gun laws. I just don't like it there.

The general culture in downstate Illinois is not anti-gun. In fact, it's pretty much the opposite - and that includes law enforcement personnel. That is my everyday experience.

If you're traveling through Illinois behave and be cool. You'll be fine.

Traveling to Il next month, plan on locking up my guns in the saddlebags once I reach state line. I will still carry a Mace pepper spray gun in place of the firearm which is legal. I don't plan on encountering any thugs while riding on the highway.
 
Go to handgunlaw.us click on rv/car carry. Then click on Illinois. Get ready for your eyes to lock up in a crossed fashion. I do not understand how anyone can make sense of this.

When I travel from Denver to the Atlanta area I avoid Illinois almost entirely by taking I-55 south to Sikeston and head east to US 60. I will cross the Mississippi River, set down on the southern tip of Illinois and then cross the Ohio River straight into western Kentucky. I may spend two minutes and that is two minutes too long in Illinois. Works for me. Avoid Illinois even if you have to go well out of your way.
 
I have one question for you since the original post makes no sense, and I didn't see anyone directly address this. WHY do you feel compelled to drive through any portion of Illinois to get to Michigan? There are alternate routes to get to MI from NW TN without going anywhere near IL. Even if you are going to the U.P. there is no reason to go anywhere near IL!

The OP had it correct in his very first post. If you have a valid CCW from your home state then you can have your loaded CCW in your vehicle while traveling thru IL. All of IL. The law applies thru out the entire state.
And while I'm sure there's still going to be someone(s) who will reply "My buddy is an attorney and he says...." or "I read this or that which says something different" here's the actual statute. And yes, it applies even in Chicago and everywhere else in the state. Quit believing internet BS. It will raise your IQ.
Here's IL's statute:
(430 ILCS 66/40)
(e) Nothing in this Act shall prohibit a non-resident from transporting a concealed firearm within his or her vehicle in Illinois, if the concealed firearm remains within his or her vehicle and the non-resident:
(1) is not prohibited from owning or possessing a firearm under federal law;
(2) is eligible to carry a firearm in public under the laws of his or her state or territory of residence, as evidenced by the possession of a concealed carry license or permit issued by his or her state of residence, if applicable; and
(3) is not in possession of a license under this Act.
If the non-resident leaves his or her vehicle unattended, he or she shall store the firearm within a locked vehicle or locked container within the vehicle in accordance with subsection (b) of Section 65 of this Act.
 
Please note that the OP titled this thread "CCW through IL", not "may I carry a gun in my automobile while travelling peacefully through Illinois without stopping".

Couple of months ago I made a road trip from Colorado to Tennessee. Oklahoma, Texas, Arkansas on the way, then back through Kentucky, a tiny slice of Illinois (at the bridge over the Mississippi at Cairo), Missouri, Kansas on the way back. A day's side trip into northern Alabama and Georgia while spending a few days at my son's place in Tennessee. No problems, no worries anywhere except Illinois.

I'm a retired cop, badge and retirement ID in my wallet, Colorado concealed handgun permit. I held my breath and crossed my fingers for about 15 or 20 minutes while in Illinois, no stops, no delays until I got into Missouri.

Best not to tempt fate if you can avoid it.

And yes, I have traveled thru parts of IL several times with a loaded and concealed weapon. But I still feel relieved when I cross the border into Kentucky or Missouri.

This. I used to drive a truck running GM parts from TN to MI and Ontario and back. I never, ever went through IL. I-65 to I-265 to I-71 to I-75 all the way up to Saginaw.

I can get to anywhere in MI from I-75.

You should have turned left at the end of that bridge and headed across the other bridge instead of turning right and driving through Cairo proper. Then you would have been in Illinois for about 30 seconds and on I57 in Missouri in about the time it took you to drive 25 mph through Cairo and get to I57 still in Illinois . . .

Hate to tell you, but your still leaving yourself up to be arrested in Illinois even doing all that.
What would you tell the cops after reporting your gun is stolen in that hotel room? Or if you defended yourself with it?

I had IL ccw for 3 years before moving to TN , I know the law in IL. I lived on the northwest side of Chicago if you follow the law you will be ok.

so I'm correct in saying that even in a locked box with no mag or ammo in the gun I'm still carrying illegally a concealed weapon for the 20-100 foot walk into the motel room. And even in the room if for some reason LEO's knock on the door and make contact cause someone called saying they suspect because of my Missouri license plate that I am carrying or bringing a gun in a box into the room can I be arrested for transporting the gun from my car in the parking lot to the room?

I'll curious to hear the reply to thread #35. I would think you would be legal Carrying from your car to the motel room, then keeping a loaded gun in the room.
I ride a bicycle. It is generally illegal to carry in a park or on a bike path. HOWEVER, if you are passing THROUGH the park or path you are legal. If I'm riding on the street, then I enter onto a bike path for however long, then I exit from the bike path, I AM LEGAL. Our instructor, who is a lifetime cop BTW, covered this pretty thoroughly in our class.
Illinois has a very strong hunting and shooting culture. (Ever heard about our big deer?) People here like guns. The cops don't care if good people have guns. Nobody's gonna mess with you. People bulge and print all the time and it's not a problem.

My last motorcycle trip was in 2015 from Michigan to South Dakota. I made two phone calls about gun transportation before we left. Son in Law who is an IL attorney and IL State Police. We all agreed that if you have a CCW (MI calls it a CPL) and can legally carry in the state you are coming from and in the state you are going too then it is legal to carry as long as you stay in the vehicle. We were on motorcycles, Dad carried his in his vest pocket (Beretta 380) and I carried a Remington 1911 in a shoulder holster. We stopped for gas once but never got off the bikes.

The way the law is written if you are carrying a gun across the parking lot and do not have an IL permit you are in violation. Leave it in your car or sleep in a different state.

No, none of that is correct. You are perfectly legal to transport a firearm in a locked box or case unloaded to your room. IL laws allow for that type of transportation. Firearms can be legally transported in a case or box unloaded outside the vehicle.
If a person has a CCW from their home state then they can have a loaded CCW in their vehicle. If they do not have a CCW then the statute below applies describing how they can transport firearms.
IL law is not as onerous as the internet "experts" keep repeating. Don't believe all the BS on the internet. People who keep posting that kind of stuff probably aren't even smart enough to find IL on a map. It's for sure they aren't capable of looking up IL statutes and understanding what they're reading even if they could find the statute. If a person can't transport a gun from anywhere how do you think people buy guns and get them home or to hunting/shooting locations? There are all kinds of out of state hunters and shooting competitions all around the state of IL, many of those competitions are national level matches. How do you think any of those shooters legally transport their firearms if a person was to believe all the internet "experts"?
Here's the statute that covers a person who does not have a CCW or moving outside their vehicle transporting a firearm:
720 ILCS 5/24-1 Unlawful use of weapons
(4) Carries or possesses in any vehicle or concealed on or about his person except when on his land or in his own abode, legal dwelling, or fixed place of business, or on the land or in the legal dwelling of another person as an invitee with that person's permission, any pistol, revolver, stun gun or taser or other firearm, except that this subsection (a) (4) does not apply to or affect transportation of weapons that meet one of the following conditions:
(i) are broken down in a non-functioning state; or
(ii) are not immediately accessible; or
(iii) are unloaded and enclosed in a case, firearm carrying box, shipping box, or other container by a person who has been issued a currently valid Firearm Owner's Identification Card;

What that means is the unlawful use of weapons statute does not apply if a person does (i), (ii), or (iii). Pretty simple really. Nothing at all like the uninformed keep repeating.
The part about the Firearm Owner's Identification Card does not apply to non-Illinois residents since non-IL residents do not need nor can they get a FOID card. So forget the part about the FOID.

You should ask your son in law do a bit more legal research. IL law says nothing at all concerning if you're legal where you're going to. I posted the statute above. Please read it and have your SIL read it. All IL CCW law says concerning out of staters is you have a valid CCW from your home state. Nothing at all about being legal where you're going to.
Either you or your SIL are confusing FOPA with IL CCW statute. 2 separate, unrelated statutes. IL doesn't care where you are going.

I'd love to go back home to visit family & friends in Chicago but I'll wait till my Missouri CCW (which is not needed in MO to Open Carry or CCW.) is accepted in Illinois.

When you rent a motel room, doesn't that become your abode? So, shouldn't you be legal, carrying between your car and the room?
