Oregon Ballot measure 114 effective date

Today the Secretary of State's office notified the Oregon State
Police, who run the background checks (4473's) effective
December 8 2022 the measure will go into effect.

The state police have said that as of that date they will not longer process background checks.

Among the more onerous aspects of this bill is the requirement
to purchase a permit to buy a firearm and a 10 round magazine
capacity limit.

Never mind, absolutely no administrative rules have yet to be
developed for implementation of any part of this bill. As of
12-8-22 Oregonians will no linger be able to buy/transfer any
firearm

I spoke to a friend of mine this afternoon who owns a gun store
and he advises that as of today there are over 13,000 individuals waiting for background checks which translates to a wait of a bit over 4 months for a yea or a nay.

That is the fact/issue that has me just screaming. A Bill he been passed, (the greater Metro Portland area dictating the rest of the state,) before anything clear and tangible has been written into it. I'm not an attorney but that doesn't seem legal.

I asked my local Police Chief about the particulars. Is it a permit for each and every purchase? Is it a all inclusive permit meaning blanket coverage? Is the firearms training certification required for each purchase or good for all? What about Concealed Carry Permittees? What about CCR FFL holders. What about NFA Stamp holders. (That's me all three.) He said he didn't know as it's still being figured out. Wow.

I'm glad the "arsenal" tax/license/restrictions have gone away. That really freaked me out. It was brought up a few years ago and the definition of an "arsenal" was something like 25 firearms. Maybe a few more but still as a collector I was outraged.

Oregon has been becoming California for some time. I remember Tom McCall warning of this in the seventies complete with the giant billboards that were so controversial.

It looks like there is more info today. A permit to purchase a firearm will cost $65.00 good for 5 years. The firearms competency class, paid by the purchaser at an unknown cost, (and by who,) would be good for 5 yrs also.

In regards to 10+ mags, they will be "marked", (?.) but those in prior possession would be "legal" to possess, use and transport. How would they determine prior? Too funny yet kinda scary too.

It's a mistake for me to say I don't care. In anticipation of this "law" passing I'm good on ALL my plus 10 magazines and I really don't need to acquire any more firearms until the issue is settled.

I can't see how a $65 permit to exercise the fundamental Constitutional right to own and bare arms is different from a poll tax to exercise the fundamental Constitutional right to vote. The poll tax is unConstitutional but the permit fee isn't?

Precisely. I would expect the current SCOTUS to strike down laws that require an exchange of money or anything else in order to enjoy a right that is defined in the constitution.

I too think this will be knocked down when it gets to the courts.
But how long will that take?
In the mean time there is a lot of confusion and miss information going around. People are buying guns at very high rate and can't get them through background checks. Various Police Chiefs have said they will not enforce the magazine capacity part of the law and it goes on.
One thing that seems to be a fact is that a lot of gun shops will go out of business and people will lose their jobs. Gun shows won't be like they used too.
It is going to be a difficult and confusing time for Oregonians. Let's hope this can be somehow fast tracked to the courts for resolution.
December 8th is the deadline. Buckle up it's going to be a rough ride.
 
I lived in Oregon for a few years and man what a land of contradictions. Just driving from Salem to Portland was like traveling to another planet.
 
Same old thing. NY has used this playbook for years. Pass s bunch of laws. Implement a bunch of requirements but have no process for either. They usually dump it on State Police. Who usually argue they can't do it. And then most of the Sheriffs announce they wont enforce it. Then it goes to court and gets struck down. It's actually harassment. It puts everything on hold because law biding citizens don't know what they can or can't do.
 
I pointed this out once before and my post disappeared for unknown reasons. The issue we have in Oregon is that while the vast majority of the state is rural farmland and forest the majority of voters live in Portland. So, no matter what 90% of the state wants our laws are dictated by Portland.
 
Just an update to those that might care---As of 4:30 on thursday afternoon, the "instant" back ground check waiting list was up to 15,429. On the good side this means that this new law has helped sell over 15,000 firearms into Oregon in just over 2 weeks. Make one wonder how this is effecting the prices on the street of those acquiring their firearms without the required back ground checks.

Oh ya---nobody has mentioned that the ammo shelves that were almost back to being filled, are now once again being emptied.


I feel so warm and fuzzy and safe, I almost can't stand it. Maybe a late nights stroll through inner city Portland will be safe once again----NOT.

Oh ya---I almost forgot to mention what a HUGE help the NRA was in helping to defeat this new law. Wayne and the entire organization will not loose just my contributions, but also any or all future respect or funds from any members in Oregon. As far as we can tell, the mighty NRA did not spend a single nickel to even try to help us out. THANKS for nothing!!!

Please rest assured that this was written several times so that I would not get the boot from this fine forum. :)
